Cesare Battisti's prison regime has been declassified from high security to common

.

According to what ANSA learns, the provision of the prison administration was notified directly to the former terrorist in the prison of Ferrara, where he has been since June 2021, requested for some time by requests from Battisti himself.

The high security where Battisti was located is a section of the prison where those convicted of association-related crimes are held, subject to closer surveillance than ordinary prisoners.

However, the change in the prison regime does not affect the sentence

- Battisti will continue to serve a life sentence - or on prison benefits, which belong to the judiciary.

It was the former terrorist himself who urged him, reiterating his desire "to serve his sentence positively and constructively".

From the prison of Ferrara now Battisti could be transferred to Parma.

Battisti, arrested after 37 years on the run, in the interrogations of March 2019, in front of the head of the anti-terrorism pool Alberto Nobili, confessed to the murders committed and expressed his total dissociation from his past in the armed group.

Now, therefore, like most of the other inmates, Battisti will serve his sentence in a medium security regime.

But somehow he will not be a common prisoner, because the DAP Maximum Security Office - the same that signed the order - will continue to have him under management.

The favorable opinion of the Milan Public Prosecutor: "There was a dissociation from the armed struggle"

In recent months, from the Milan Public Prosecutor's Office, through the head of the Milanese anti-terrorism pool Alberto Nobili, a favorable opinion has come to the 'declassification', from high security to common, of the imprisonment regime for Cesare Battisti.

An opinion forwarded to the Dap and in which, as far as it was known, it was indicated that the former terrorist had a dissociation from the armed struggle, that the group in which he was active, that is the CAP, has dissolved, because it was dismantled between '79 and '80, and that no investigations are underway against it.

The opinion of the Prosecutor did not avoid controversy: it is the "

last aid to red terrorism

", according to the Brothers of Italy, who announced a parliamentary question.

"At the end of the term

there are those who have seen fit to act quickly in favor of 'comrade Battisti'

", attacks the parliamentarian of the League Jacopo Morrone.

Alberto Torregiani: "Shameless decision beyond all logic"

The decision was severely contested by Alberto Torregiani, the son of the jeweler killed in 1979 by the Pac in a shooting in which he himself was injured and lost the use of his legs: he was "shameless and spartan, beyond all logic" accept the request presented by Cesare Battisti's defenders to downgrade his prison regime from high security to common.

"I do not agree with this decision.

Then he will make other requests that could be approved

, such as that of social work first in prison and then outside".

For Maurizio Campagna, brother of Andrea, the agent killed by Cesare Battisti on 19 April 1979

in Milan, "

it is enough for him to discount the sentence

that was imposed on him for the crimes he committed".

The Legal: "Right to declassify it, the last crime in 1979"

The provision of the Dap, explains Battisti's defender, the lawyer Davide Steccanella, "has remedied after 2 years an incorrect classification of the dangerousness of the detainee. Battisti was considered dangerous as he was convicted of terrorism, but it is no longer current data that the last crime committed by Battisti dates back to 1979. This classification was applicable when the crime of terrorism of a political matrix, which now no longer exists. Battisti - concluded the lawyer - what could he

possibly do, go back to doing the armed struggle alone 40 years later?

It was just a misclassification and whoever wants to make controversy, does it in an instrumental way ".

The opinion of the guarantor

"To judge these measures of the penitentiary administration one must know the norms and laws

. To say that it is not acceptable is to admit that you do not know"

.

Thus the regional guarantor of persons subjected to restrictive or restrictive measures of the freedom of Emilia-Romagna, Roberto Cavalieri, on the question by Galeazzo Bignami on the declassification of Cesare Battisti's prison regime.

"This person followed the regulatory process correctly,

the prison administration recognized what it could not fail to recognize

. Declassification does not mean that the prison administration cancels the fact that he committed terrorist crimes, but it is a management and logistical issue . It does not affect the type of conviction he has had. It means that he becomes a common prisoner. "
