case of Esther López

The images had been requested by OSM's defense and their request was supported by the Prosecutor's Office, which asked the Court not to uphold the appeal filed by the victim's lawyer.

The magistrate considers that "the appealed diligence is

pertinent and necessary

since with it the defense wants to prove that, when the Civil Guard intervened the vehicle of its client, it did not present the "dent" referred to by the ERAT -team of the armed institute that investigates traffic accidents - in its report, which includes the compatibility of this defect" with the injuries to Esther López's body and the mechanics of the accident.

It adds that

"the error"

made by the victim's lawyer is evident, since "when it is indicated that by the mere fact of exerting perpendicular pressure, it yields, he is not referring to the slight dent in the bumper, which yields It's the fog diffuser.

In her resolution, the judge explains that "in the criminal proceeding, the party does not have to prove that the investigative diligence requested is available to the person under investigation, nor that they have made a minimal effort to obtain it without success, (the criminal jurisdiction is being confused with the civilian)".

for the investigated party to inform the Court of the reason for the request for the diligence, which in this case and as has already been explained, is more than evident."

The defense of one of the three investigated for the violent death of Esther López

requested explanations

, before the Court that deals with the proceedings, for a dent in the car of his client, Óscar, since he assured that it did not exist when he delivered the vehicle for inspection.

Sources in the case explained to Efe that an expert report dated July 26, 2022 from the Civil Guard accident reconstruction team includes a frame in which a "slight dent" of plastic material can be seen in the vehicle of the investigated, a T-ROC gray.

The defense maintains that

this "dent" did not exist

at the time the vehicle was handed over by the person under investigation to the Civil Guard, which is supported by a frame provided to the Court, which corresponds to the moment in which the agents removed the vehicle with a crane and which was broadcast on television and published in various print media.

For these reasons, it considers that the expert report, at least in the section on "anomalies observed in the vehicle", suffers from a clear "irregularity".

Esther López, 35,

was last seen alive in the early hours of January 13 and was found dead in a ditch on February 5, in the Valladolid town of Traspinedo, where she lived.

The autopsy revealed that the death could have been of accidental or homicidal etiology due to a hit and the immediate cause of death was multifactorial shock.

Óscar, Ramón and Carolo remain under investigation in the case, while the proceedings to clarify the case continue.
