A partial civil court in Ras Al Khaimah rejected a lawsuit filed by a Gulf national demanding compensation of 90,000 dirhams for the damages he sustained as a result of his ex-wife filing a complaint against him at the police station on charges of assault and insult. .

The defendant's attorney stated that the plaintiff took over Sabha by phone in the presence of witnesses, and in a separate incident attacked her physical integrity and damaged her phone, and a report was drawn up on the incident in a neighboring emirate and reconciliation was made between them after she relinquished the communication, explaining that the verdict of acquittal of the plaintiff does not necessarily prove her mistake and he has no right Claiming compensation for non-fixed damages and requesting the rejection of the claim for lack of validity and substantiation.

The plaintiff’s attorney confirmed that the material and moral damage inflicted on his client is proven after she falsely accused him of insulting him, and a verdict was issued to acquit him, and she knew that the incident was not true.

The Partial Civil Court of Ras Al Khaimah said in the merits of the ruling that after examining the case papers and the penal ruling issued against the plaintiff and the investigations and criminal cases filed about it, it is not considered arbitrary in the defendant’s use of her right to litigation, which is a right guaranteed by law and the constitution, especially that the communication she submitted As a result, charges were brought against the plaintiff.

She explained that the verdict of acquittal of the plaintiff by virtue of a final ruling could not in any way conclude from it the lack of seriousness of the defendant's complaint and its abuse of the right to litigation. The issued acquittal of the plaintiff cannot have absolute authority before the civil court, especially since he did not base the plaintiff’s innocence on the absence of attributing the acts to him with what the court deems that the case as it is lacks evidence in the absence of proof of the defendant’s fault.

She explained that as long as the court is convinced that the defendant has exercised her right to litigation without abuse and has not abused her right, the court will turn to reject the case.
