• TSJC Justice knocks down Aragonès' attempt to suppress 25% of Spanish this course

  • Language From the final judgment of 25% of classes in Spanish to the new regional legal umbrella

The Catalan Minister of Education,

Josep Gonzàlez-Cambray

, opened the current academic year by assuring that "no center will apply percentages in language learning".

The reality, on the other hand, is that some twenty schools are still resisting pressure from the Generalitat to disobey the court ruling of

25%

Spanish.

The decision of

the Superior Court of Justice of Catalonia

(TSJC) not to revoke the precautionary measures that set 25% of teaching hours in Spanish in two schools in Vila-seca (Tarragona) and El Prat de Llobregat (Barcelona) forced yesterday to the council to back down on its decision to meet this Friday with the directors of schools and institutes affected by judicial resolutions, a meeting of which Education sources consulted by this newspaper said they had no record of not being on Cambray's public agenda.

As reported by the

Assembly for a Bilingual School

(AEB), the ministry intended to convince those responsible for the centers not to apply the ruling and to be governed by the new regional regulations with which the Government has avoided, for now, compliance with the sentence, which has been firm since last January.

The AEB denounces the "pressures" that Cambray wants to exert on the more than 20 centers affected by court orders.

Specifically, according to the data of this entity, there are eight directors who at the beginning of the course have already disregarded the ruling of the TSJC.

They are responsible for the

Turó del Drac

(Canet de Mar),

Salvador Dalí

(El Prat de Llobregat),

Valèria Haliné

(Castelldefels),

Milagros Consarnau

(L'Hospitalet de Llobregat),

Josefina Ibáñez

(Abrera),

La Falguera

(Vilanova del Vallès),

Vinya del Sastret

(Sant Esteve Sesrovires) and

Vedruna

(Palamós).

With the meeting finally cancelled, in which the Education Inspection and the legal services of the Generalitat were also going to be present, Cambray sought to convey peace of mind in the face of non-compliance and convince the twenty remaining directors that they must follow the Department's orders.

regional regulations

The legal umbrella against the court ruling is made up of the Government's

decree law

on linguistic projects in educational centers and the law on the use and learning of official languages in non-university education that the

Parliament

approved in June with the votes of the

PSC

,

Esquerra Republicana

,

Junts per Catalunya

and

En Comú Podem

.

The first norm explicitly establishes the "non-application of numerical parameters, proportions or percentages in the teaching and use of languages", while the second establishes Catalan as the "vehicular" language and reserves the status of "curricular" for Spanish.

The

Constitutional Court

now has on the table to study several articles of the regional regulations, since the TSJC raised a question of unconstitutionality two months ago on the decree law of the Generalitat and the law of the Parlament.

The magistrates considered that they could be violating some precepts of the

Constitution

and the

Statute

.

In parallel, the

Popular Party

and

Ciudadanos

jointly presented an appeal of unconstitutionality against the decree of the Government.
