For its part, the court clarified in the merits of its ruling that, according to the decision of the Civil Transactions Law, every harm to others obliges the doer, even if he is not distinguished, to guarantee the harm, noting that the plaintiff had previously submitted a complaint before the competent authorities against the defendant and was convicted of what was attributed to her under a penal judgment, Hence, the judgment has acquired the authority of the res judicata before this court with regard to the availability of the elements of tort responsibility.

The court indicated that the defendant’s mistake was established under the penal provisions, and had caused the plaintiff material damages, represented by the police station’s review to open a report and the value of the transportation, as well as moral damages such as compromising her honor and dignity and insulting her consideration, which would make her the object of contempt for others, pointing out that the plaintiff deserves A final total compensation of 15,000 dirhams, and the court obligated the defendant to pay the plaintiff 5,000 dirhams to complete the punitive compensation and oblige her to pay fees and expenses.
