The mother of the teenage girl has asked an Orange County Superior Court judge to place her in a new program that allows the accused to avoid jail, according to court records.

  During the beating, the video recorded by the live audience can be heard from the mother, 46-year-old Hunter, who is also the defendant in the case, shouting to her daughter, "You better hit her."

Hunt's attorney Brett Greenfield applied for a pretrial misdemeanor transfer program in July, and his client had no prior criminal record, the attorney said in court documents.

"The defendant respectfully asks the court for clemency. The defendant is a single mother of two daughters and has never been charged or convicted of a criminal offence prior to this incident."

  He added that Hunter "has been a source of national news exposure, ridicule, racist threats and rants for months, and because of the nature of the violent threats, she was forced to hide in a hotel with her children. The young daughter was taken out of school for months, and it is only now that her life is starting to return to normal."

  Hunter "has paid a heavy price and will always be subject to the threat of onslaught due to social media posts and replays of events," Greenfield said.

  He also noted that prosecutors said they would not object if the defendant wrote a letter of apology to the victim, took a 10-week anger management course, then participated in youth sports again, and agreed to the victim's distancing order.

  Hunter is due to appear in court on September 14, where she is charged with misdemeanor facilitation of juvenile delinquency and battery.

Hunt faces up to a year in prison if convicted.

Instigated by Hunter to punch the Chinese-American daughter, whose father is former NBA player Corey Benjamin, he issued a statement on social media shortly after the game, apologizing for his daughter's behavior.
