Tunisia: silence of the presidency after the suspension of the dismissal of judges

No reaction from the Tunisian presidency, two days after the decision of the administrative court to suspend the presidential decree dismissing around sixty judges.

On June 1, President Kais Saeid dismissed 57 magistrates.

This decision was suspended for 47 of them.

Only 10 dismissed judges are not affected by this suspension, as they are the subject of criminal proceedings.

According to the magistrates concerned, the return to their post must be possible upon receipt of a copy of the

judgment of the administrative court

.

According to the Constitution, the decision of the administrative court is final.

No appeal is possible.

Some, like Kamel Ben Messaoud, president of the association of young magistrates, ask

President Kaïs Saeid to

apologize or at least to explain himself. 

But does the Tunisian state intend to apply this court decision?

The spokesperson for the Ahrar alliance, a movement close to the president, affirms that "

 the suspension of the dismissal will not prevent these judges from being prosecuted in court in criminal cases

 ".

However, according to the administrative court, the files are empty and no criminal or moral prosecution concerns the 47 judges restored to their position.

The resignation of the Minister of Justice requested

Justice Minister Leïla Jaffel is accused of negligence and misleading the president.

Her resignation is demanded and the local press citing official sources ensures that she will be part of the next government reshuffle.
