Tariq Ramadan, does everything to avoid the Assizes.

The lawyers of the Swiss Islamologist filed an appeal on Friday to suspend the judicial investigation targeting their client accused of rape in France.

They thus hope to avoid the decision of the judges to send Tariq Ramadan to the Court of Assize.

The lawyers rely on the fact that the validity of the psychological expertise on the "hold" of their client on four plaintiffs has not yet been examined.

On July 12, the Paris prosecutor's office requested a trial at the assizes for the Islamologist, suspected of rapes committed between 2009 and 2016 on four women.

It has since been up to the two investigating judges in charge of this case to issue their final order, either of indictment before an assize court, or of dismissal.

The prosecution justified its requisitions by a notion that punctuated this file: the victims "were all under the influence" of Tariq Ramadan "in view of the admiration, even the veneration that (he) exercised on them".

The "legality" of these contested expertise

Tariq Ramadan's lawyers point to the fact that the prosecution's final indictment is based "largely" on psychological and psychiatric expertise concluding on the "grip" he would have had on the complainants.

However, they challenged the “legality” of these expert opinions by a motion for nullity which has not yet been examined.

"By renaming the expert who had made a mistake and caused the cancellation of a first expertise, by adding a second expert who is no longer of legal age to practise, the judges suspected that we would exercise by right.

However, they are trying to force their way through, ”said one of Tariq Ramadan's lawyers, Me Philippe Ohayon.

His lawyers have thus filed a motion for suspension with the president of the investigating chamber of the Paris Court of Appeal, so that the investigating judges cannot issue their final order until the motion for nullity has been will not have been examined.

The President's decision will not be subject to any appeal.
