Court of Instruction Number 3 of Castellón has admitted the expansion of the complaint

that a few months ago a family from Castellón filed against the former vice president of the Consell Mónica Oltra, as well as other senior officials and technicians of the Ministry of Equality and Inclusive Policies for the alleged crimes of

illegal detention, prevarication and obstruction of Justice

, to which is now added that of coercion.

The complaint also extends to the delegate, Luis Gómez;

former delegate Carmen Fenollosa;

María Jesús Fernández, responsible for the Families and Adoptions area, as well as the social worker Nuria Del Río.

The reasons were that the

Ministry did not recognize the paternal grandparents of the minor,

Carmen Montaño and Juan Francisco Guijarro,

for the reception of their granddaughter, who is currently under the care of an external family unit without any kinship.

In addition, they also seek that the minor is not adopted by those who, shortly after birth, welcomed her by decision of the Ministry,

and that she can meet her brother, who is in the care of her grandparents.

The events date back to 2017, the year in which the fight began, first administrative and then legal, to assume the protection of the minor since it was then, specifically on December 1, 2017, when the girl, daughter of DG (her parents are the complainants) and CJ At the time of the birth, the father was not present in Castellón after having left the province to reside temporarily in Catalonia due to personal problems.

A month after her birth, the Ministry that Oltra directed decided on January 2, 2018 to declare

the newborn in a situation of abandonment, as well as her fostering in a family outside the

biological environment of her parents.

The mother herself opposed

from the beginning the delivery of the minor to a foster family unit

and the grandparents did not take long to join

the same claim with writings without response to the territorial delegation of the Ministry to assume the guardianship and care of their new born.

In the midst of the silence of the administration, in 2018 the battle began in the courts with the opposition to the protection measures adopted by the Ministry to keep the baby in the hands of a family without blood ties.

in 2019 in favor of the plaintiffs, estimating that the biological family of the two parents should have been privileged as the recipient

of the protection of the minor against the alternative of a foster unit without a family relationship. relationship.

In addition, the Justice recognized that the Ministry did not carry out an examination on the evolution of the family or on the aptitudes for the performance of parent-child obligations.

That sentence annulled the resolution of the Ministry that agreed to custody for adoption purposes and urged the department led by Oltra to develop a family intervention plan aimed at reintegrating the baby with her closest family.

Despite this, the Department never responded to the court order

Instead, he appealed, and first the Provincial Court and, subsequently, the Supreme Court ratified in a final judgment the ruling of the court in favor of the plaintiffs.

For this reason, the grandparents, accompanied by relatives and other people,

protested this Thursday at the door of the City of Justice

"irregular attitude in the procedures for the fostering and adoption of minors."

In a statement, they explained that “the Ministry refuses to comply with the judicial decisions that have been issued in the last four years and that they agree to nullify their actions.
