As in 2021, the public prosecutor requested the dismissal after the death of Babacar Gueye, shot dead by a police officer in 2015 in Rennes.

After studying the last acts claimed by the civil party, Philippe Astruc believes that the police officer who fired acted in self-defense, which the family of the deceased disputes.

On the night of December 2 to 3, 2015, Babacar Gueye received five bullets fired by a police officer from the anti-crime brigade in the stairwell of a building on rue Guy-Ropartz, in the Maurepas district.

The man was armed with a knife and was very threatening according to the police.

A version disputed by the friend with whom the victim spent the evening, who speaks of a crisis of “dementia”.

In the apartment, the Senegalese would have started to scarify his abdominals with a knife, injuring the way the friend with whom he spent the evening.

In February 2021, the prosecutor had already pleaded for a dismissal in favor of the police officer, considering that he had acted in a state of self-defense.

The latter had been placed under the status of assisted witness.

New investigations had been requested by the family of Babacar Gueye, in particular a forensic and ballistic expertise and an analysis of the genetic fingerprints and papillary traces present on the knife.

The new ballistic expertise gave nothing

According to the prosecution, the ballistics expertise "concluded in particular the compatibility of the versions of the police with the ballistic data".

Results criticized by the lawyer for the civil party, who considered “that no information capable of feeding the manifestation of the truth” could not be extracted.

After this request for dismissal made by the prosecutor, it is now up to the investigating judge to decide on the consequences of the judicial investigation.

The latter could decide to close it or to proceed with an indictment with a view to a trial.

The order is expected "in the coming weeks" according to the prosecution.
