María Lizarraga
, the former member of ETA who was surprised by the French police in 2008 with pistols, explosive devices and documentation of the gang, is already enjoying the third grade with a control through a telematic bracelet.
Lizarraga was serving a sentence in
the Zaballa prison (Álava)
, where she was transferred in January 2022 for being pregnant.
Six months later, the woman convicted of terrorism has not been transferred to the new module for mothers enabled by the Government of Urkullu in the Martutene prison, but she is already on the street.
Organizations that watch over the rights of "prisoners sentenced for political reasons" applaud the prison policy of the Government of Urkullu against the "obstructionist position" of judges of the National High Court.
The Basque Government has authorized María Lizarraga to serve her sentence outside of prison, an administrative decision that has been appealed by the National High Court Prosecutor's Office.
Lizarraga was transferred to the Zaballa prison in January in an ambulance when she was three months pregnant, an exceptional procedure that the former ETA member premiered and that, according to prison sources, has not been used with any inmate again.
After Lizarraga's transfer to the Alava prison, the prison adviser and judge

met with those responsible for the Martutene prison in San Sebastián to adapt one of the modules of this prison as a space for mothers with children.

Beatriz Artolazabal brought forward the presentation of this
maternity module
on May 20
when the works had not yet been completed, but, as confirmed by sources from the Basque Government, the facility is now available for use by the inmates.
Despite this, the Urkullu Executive has chosen to release Lizarraga, who already had a daughter in prison as a result of her relationship with fellow ETA member

The two inmates, supported by groups related to the EPPK prisoner group, have requested to finish their sentences in the third degree to deal with the education of their daughter

, who turned three years old in January, the limit established by law to live with their parents in jail.
Gutiérrez achieved the third degree last February, but the National Court revoked a decision adopted by Penitentiary Institutions and is serving his last months of sentence in Zaballa prison.
Currently, 22 ETA prisoners already enjoy the third degree which, for the most part, makes it easier for them to serve their sentences at home without going to Basque prisons.
The
Permanent Social Forum
that watches over the rights of ETA prisoners acknowledged yesterday that since an interview granted by Pedro Sánchez in May 2018 "much progress has been made", especially in bringing ETA members closer to the Basque Country and Navarra and the transfer of the prisons to the Government of Urkullu.
