This came as part of episodes presented by the Legal Counsel, Dr. Youssef Al Sharif, through the pages of "Emirates Today", to shed light on the Personal Status Law, and its developments.

Al-Sharif presented a message from a follower on social media, in which he says: “I was born in the country, and my father is 65 years old. By bringing me and my mother to the state, who endured his circumstances for a long time and my three brothers, and we joined schools and universities until we graduated, and my father had a private job and a thriving trade, he succeeded in creating wealth and became coveted, and he finally met an (Arab) girl the age of my sister who lives and works in the state.

The questioner added that his father’s condition was greatly affected by his relationship with this girl and his attraction to her, so he neglected his job, incurred financial losses and was robbed from some of his workers, in addition to spending lavishly on this girl, providing her with housing, and always buying her expensive gifts, indicating that his mother She suffered greatly from this condition and fell ill.

He added that he and his brothers were obsessed with losing their father's money that he collected during the years of alienation, wondering about the legal action in such a case, explaining that he is the eldest son who bears the responsibility of the family, and his brothers ask him to find a solution, so can he file a stone lawsuit against the father when he is foolish and spend his money this way?

For his part, Dr. Youssef Al-Sharif said that the legal solution in such a case is for the questioner to apply to the judge of temporary legal matters in the Personal Status Court in the emirate in which he resides, and to request that an order be issued on a petition to appoint him as a trustee over his father and manage his money, as he is the eldest of the sons.

Al-Sharif stressed the importance of knowing the role of the custodian, as guardianship is a type of legal representation over funds, and the custodian appointed by the court is responsible for representing the interdicted and taking care of his money and managing it, and the custodian is the person appointed by the court to take over the management of the interdicted’s money and affairs due to loss or deficiency of capacity, foolishness and misconduct Financial, as the questioner claims that his father is in this case.

He added that in terms of procedures, the questioner must submit the request stating what we call in the law “sloppy,” and what is required is to appoint a trustee and prove his financial misconduct, such as what he said in terms of his relationship with this girl and spending on her, his age, the deterioration of his business and his loss, and all These matters, and the application is submitted to the judge of temporary legal matters, and the Public Prosecution Office, and his mother and brothers, are announced as the potential heirs.

Then the order is issued to accept the request, and if it is rejected, the decision can be appealed, and it can be appealed according to Article (10) of the UAE Personal Status Law, which states: “In cases where the law requires obtaining the court’s permission or approval, or the law requires the lifting of The order is submitted to the judge. The request is submitted to the court in which circuit the student’s domicile or residence is located, by virtue of an order on a petition, unless the law provides otherwise. It also stipulates that anyone with an interest may file a grievance against this order within a week from the date of its notification, and it is issued The court rules in the grievance to support, amend, or cancel it, and this ruling is subject to appeal by the methods of appeal established in the law, and the request for the appointment of the trustee is by order on a petition, and the prosecution and potential heirs are notified of the request.
