The defendant was convicted under a penal judgment, which resulted in material and moral damages to him. The material damages consisted of deleting the account of the institution and the groups in which it participated, and depriving him of communicating with clients, in addition to the moral damage resulting from his inability to access the account his foundation.

In the ruling’s rationale, the court stated that it is decided, according to the Law of Evidence in Civil and Commercial Transactions, that the plaintiff must prove his right, and the defendant has the right to deny it, noting that what is established from the penal ruling is that the defendant has been referred to the criminal trial on charges of entering the information system, e-mail and website The electronic mail of the plaintiff-owned institution without his permission, and illegally stayed in them, and this resulted in the deletion and change of its data, which makes the elements of responsibility of error, damage and causal relationship available in the right of the young man.

The court indicated that the young man’s mistake had resulted in material damages to the plaintiff, represented by his loss of the institution’s clients, in addition to the moral damages he had suffered, represented in his grief and loss, due to what the defendant had done, and ordered the young man to lead to the institution 10 Thousands of dirhams, and obligated him to fees and expenses.
