For his part, Legal Adviser, Mohamed Naguib, said that "the new law on drug control included a very important amendment, which is to reduce the treatment and rehabilitation period for one year instead of two years, which would reduce the cost on the family and speed up the reintegration of the recovering into society."

In detail, Colonel Abdullah Al-Khayyat said, "The department's periodic examination and aftercare program plays a major role in treating and integrating former addicts from penal and correctional institutions, or young people who surrender voluntarily or their relatives report them," stressing that "the police assume this role to protect the recovered." Al-Khayyat stressed that "the Emirati legislator treated the patient with great humanity and gave him several options that allow him to treat, rehabilitate and recover without accountability or punishment, and in addition to that, the police forces in the country, especially Dubai Police, show greater flexibility to encourage parents to cooperate and save their children in a timely manner." .

He explained that "as soon as the father, mother, or any family member requests that the son be subjected to the periodic examination program, he is investigated by those in charge of the program, and follow-up begins on an ongoing basis to ensure his commitment."

He pointed out that "the importance of this procedure, whether by resorting to the Dubai Police or treatment institutions, lies in early detection, because the delay reduces the chances of treatment, and this must be done in agreement with the son and convince him that this will help him recover and save him from a trap that may eliminate him."

Al-Khayyat said, “Early detection is a brave decision taken by a conscious father or a vigilant mother, because it depends on indications that the son may be in danger, including exaggerating the request for money, or not asking for money at all, because this is a warning bell that can ask the father himself. For his part, Legal Counsel Muhammad Naguib said that there was an important amendment in the new law on the issue of treatment and rehabilitation, as it reduced it from two years in the old law to just one year in the new Law No. 30 of 2021 in the matter of drug control.

He added that the Emirati legislator dealt with the aspects related to drug abusers with a lot of humanity and consideration. Article 89 of the second chapter of the law stipulates that “the criminal case shall not be instituted against the abuse of narcotic substances or psychotropic substances, if he presents himself, his spouse or one of his relatives up to the second degree, Or whoever raises him to the unit, the Public Prosecution, or the police before his arrest or before a warrant for his arrest is issued, requesting that he be deposited for treatment with the unit, and he is deposited with it until it is decided to expel him.”

It also stipulated that “in cases where the deposit is at the request of a non-user, the depositing authority must obtain the approval of the Public Prosecution when depositing a drug user or removing him from the unit, and the Public Prosecution orders his deposit when it is proven that he has abused narcotic drugs or psychotropic substances, and in all cases no The duration of treatment and rehabilitation may exceed one year.

He explained that the last paragraph amends Article 43 of the old Law No. 8 of 2016, which stipulated in its fourth clause that the period of treatment, rehabilitation and care may not exceed two years.

Najeeb pointed out that Article No. 79 of the new Law No. 30 of 2021 dealt with the issue of periodic examination in some detail, stipulating that “a person convicted or deposited by order of the court shall be subject to the crime of using narcotics or psychotropic substances or the crime of refraining from giving the examination sample without justification.” periodic examination, during the execution of the penalty or during the deposit period, and the periodic examination continues for a period not exceeding two years after the execution of the penalty or the end of the deposit period.”

The same measure shall apply to the abuser against whom a penal order has been issued, against whom a criminal case has not been instituted, or who has been referred to the unit by order of the Public Prosecutor for a period of two years from the date of the penal order or leaving the unit.

“A legal amendment reduces the period of addiction treatment and rehabilitation from two years to one year.”
