Will Richard Ferrand live a “horribilis” week?

In any case, it got off to a very bad start for the now ex-president of the National Assembly, who was ejected from the perch after his defeat on Sunday evening in the legislative elections in his stronghold of Finistère.

Emmanuel Macron's loyal lieutenant will also be at the center of the debates on Wednesday before the Court of Cassation where the appeal filed by Anticor will be examined.

The association will try to prevent justice from definitively classifying the case of Mutuelles de Bretagne, in which Richard Ferrand, who had been indicted for illegal taking of interest, obtained recognition of the prescription on appeal.

, broke out in 2017. Anticor then filed a complaint against the Breton deputy, suspected of having rented a property acquired by his companion from Mutuelles de Bretagne, of which he was then the general manager (1998 -2012).

After his indictment, in September 2019, for illegal taking of interest, Richard Ferrand had however obtained a legal victory in March 2021. The investigating chamber of the Douai Court of Appeal, in charge of the case, had in estimated effect that the facts referred to, committed from December 1, 2010 to June 18, 2012, had been prescribed for several years.

A second appeal filed by Richard Ferrand

Anticor has since lodged an appeal in cassation after a decision "extremely surprising in view of the facts, the position of the investigating judge and the public prosecutor's office" according to Me Jérôme Karsenti, counsel for the association.

Anticor pleads a "concealed offence", starting the prescription on the date of the revelation of the case in 2017 and not, as the defense of Richard Ferrand argues, when he ceased his functions in the company in 2012 before becoming an MP.

If the Court of Cassation confirmed the decision of the Douai Court of Appeal on the limitation period, this would mean the extinction of the proceedings.

The Court of Cassation will also examine Wednesday a second appeal, brought by Richard Ferrand who argues the nullity of the procedure on the grounds that the Paris court, seized of a complaint by Anticor, was not territorially competent to deal with it.

The investigating chamber rejected this request.
