It was last summer that the two men met the woman and her friend at a restaurant on Hamnpiren in central Jönköping.

The woman stated that she and her friend were treated to champagne and that the memories afterwards are weak.

She has fragmentary memories of the rape and that someone was filming.

The district court finds that the woman is consistent with regard to the memories from the evening and that she, when she reported, did not know who exposed her to crime.

According to the district court, no reason has emerged for the woman to wrongly accuse the defendants of crime.

Wanted to secure evidence

The older brother claimed that it was the woman who was the driving force, but the district court considers that his information rather strengthens that he was aware that the woman was heavily intoxicated.

The younger brother has stated that the reason he filmed was to secure evidence.

In the district court, lawyer Christian Berntö said that "it is probably not completely unknown to the court that it is filmed in situations like this to secure evidence".

He is sentenced for aiding and abetting negligent rape as the filming is considered to have strengthened and encouraged the older brother to continue the execution.

The district court points out, among other things, that in a film the older brother makes a face at his brother who, according to the verdict, can not be perceived in any other way than that he was aware of and appreciated the little brother's actions.
