A woman asked for a divorce from her husband, after discovering that he had married another woman, and despite her initial decision to continue with him, she could no longer stand his constant staying up outside the house, which led her to ask for a divorce.

For his part, the legal advisor, Dr. Youssef Al-Sharif, stressed the importance of amicable solutions to resolve family disputes before they reach the courts, to request divorce, in order to preserve the stability of the family and children.

This came within the episodes presented by Al-Sharif, through the "Emirates Today" platforms on social media, to shed light on the newly issued Personal Status Law.

The questioner said that she is 32 years old, and she married eight years ago, to a young man of the same nationality, and had two sons (7 and 5 years) with him, adding that “the problem of her husband is constant lying, and that she discovered his betrayal of her, and his multiple women’s relationships, as he married an (Arab) woman. and bore her a son.”

She added, "I was very shocked by the news of his marriage, but she convinced herself, to continue her married life with him, in order to preserve the children, in the hope that his condition would be fixed, but the matter did not last long, as she could no longer bear his actions, and his continuous stay outside the house, until it ended." The matter is that she asks for a divorce from him, but he is bargaining with her in return, not asking him for the back of the dowry, nor any legal rights.”

She asked about the procedures for filing a case against her husband, and is it true that if she files the case, it will take years in court, and which court is concerned with hearing her case in order to obtain a divorce, her dowry, all her legal rights and the rights of her children?

For his part, Dr. Youssef Al-Sharif confirmed that the divorce case, the delay of the dowry and the legal dues, is the jurisdiction of the court that falls within the circle of the marital home or its domicile and place of residence, and this is according to Clause (2/c, d) of Article (9) of the Personal Status Law The UAE, which states that: The court in whose jurisdiction the domicile, place of residence, place of work of the plaintiff or defendant, or the marital home is located, shall have jurisdiction to hear cases brought by children, wife, parents, or custodians, as the case may be, in matters The following: dowry, equipment, gifts, and the like, divorce, khul’, release, annulment, and separation between spouses, of all kinds.

Al-Sharif stressed that the law and the courts are keen to expedite the settlement of personal status cases, but there are measures taken by the court in the interest of the family, including offering conciliation and appointing two arbiters, but in general, the ruling is not delayed long as the questioner’s husband claims, advising that there be friendly attempts , whether by continuing, or separating, in the interest of family relations and children, but when friendly ways fail, it is necessary to resort to the courts.
