While deciding on the future of linguistic immersion and examining whether the

Government

's decree is sufficient to avoid disobedience following the order of the

Superior Court of Justice of Catalonia (TSJC

), the minimum of 25% of Spanish in some schools.

This is the case of Turó del Drac de Canet de Mar, which a few months ago experienced the epicenter of controversy when the family of a P5 student requested this 25% of the classes and the TSJC ordered it to be applied in a precautionary manner.

The decision caused some 28 families of 30 children from the same course to appear before the court demanding the suspension of the precautionary measure and the return to immersion.

They claimed that there was a detriment to the students receiving classes in two vehicular languages ​​and that is why they insisted on not imposing the 25% while awaiting the sentence.

However, the TSJC has rejected the appeal after considering that the jurisprudence has ruled out that "the application of the linguistic conjunction system entails an eventual irreparable damage to a supposed right of the students to a vehicular monolingual teaching".

For this reason, it maintains the precautionary measures in the school and forces 25% of the classes to be held in Spanish because a family requested it, advised by the Assembly for a Bilingual School of Catalonia

Precisely this entity stressed that "the court remains firm in defense of the model of linguistic conjunction" and "does not recognize the right to school only in Catalan."

The Generalitat had positioned itself in favor of the families who wanted to put an end to the precautionary measure, who argued that "there is no legal basis that supports 25% of Spanish, it is a construction of the courts."
