Events Two incarcerated are released after "a total turnaround" in the investigation of a gang rape in Malagueta
Malaga Police arrest three men in flagrante delicto for a group sexual assault on a woman in La Malagueta
The woman who had filed a complaint for having been the victim of an
alleged rape
in the Malagueta area of the Malaga capital at the beginning of May, for which three men were arrested, has withdrawn the complaint, as confirmed by the Court of Instruction number 5 of Malaga.
This has been indicated by the
Superior Court of Justice of Andalusia
(TSJA), specifying that in the coming days said court will make a decision on the progress of the open judicial process.
These sources have indicated that the woman appeared
voluntarily
this past Tuesday in the investigating court, which was on guard duty for detainees, where she proceeded to
withdraw the complaint.
Last week, the case turned around after new evidence appeared, specifically some audios sent by the woman to a friend, which he presented to the investigators, in which she
would deny having been sexually assaulted
and would come to recognize that she had gone ahead with the complaint to obtain certain benefits or permits.
At the beginning of the appearance on Tuesday, the woman stated that she
did not remember anything that happened
and the judge ordered the WhatsApp audios that she would have exchanged with a friend to be played in her presence.
After this, he asked the young woman again if she still wanted to continue with the procedure and this time, the woman
answered no
and chose to withdraw the complaint, according to Diario 'SUR'.
The court agreed a week ago the
provisional release of the two detainees
who were in provisional detention in relation to this complaint, after estimating the appeal presented by the defenses when these audios were incorporated into the procedure.
