One day after the expiration of the term dictated by the Superior Court of Justice of Catalonia (TSJC) to comply with the 25% sentence, the Government has approved a decree in which it certifies its refusal to establish a minimum quota of subjects in Spanish in schools and obliges their directors to comply with the guidelines of the Generalitat to maintain Catalan as the only "vehicular" language and continue applying, therefore, linguistic immersion.

The decree -which will enter into force in the next 24 hours- promotes the "non-application of numerical parameters, proportions or percentages in the teaching and use of languages", that is, it explicitly rules out abiding by the ruling of the TSJC, which requires the Generalitat " adopt the necessary measures to guarantee that all students receive instruction effectively and immediately through the normal vehicular use of the two official languages in the percentages that are determined and that they may not be less than 25% in either case.

«Percentages cannot be applied to the use of languages.

Language learning can never be done with percentages.

It is impossible to approve a monolithic regulation throughout the Catalan territory”, argued the spokeswoman for the Catalan Executive,

Patrícia Plaja

, to certify the disobedient will of the Government chaired by

Pere Aragonès

.

Instead of accepting the sentence and ordering the management of all the centers to apply it, the Department of Education of the Generalitat will ask the schools to "adapt" their "linguistic projects to current regulations."

That is to say, that they adhere to the Catalan Education Law (LEC) and the new law, designed by the PSC, ERC, Junts and the

commons

, which, once approved in Parliament, will continue to consecrate Catalan as the only language « vehicular” and avoids committing to teach one more core subject in Spanish, as the TSJC demands.

It will be the Generalitat who "reviews and validates" these linguistic projects and who will "ensure" that they "comply with that regulatory framework."

“If they are not adapted, they will be modified,” added the Government spokeswoman, evidencing that the Catalan Government will deprive the centers of all autonomy to apply the sentence.

In fact, the Minister of Education,

Josep Gonzàlez-Cambray

, will send this Tuesday "specific instructions" to the directors on the linguistic regime of Catalan schools.

The Government maintains that both these orders, as well as the decree and the law agreed with the PSC seek to "protect" the directors and that the Ministry "assumes all responsibility for the legality" of the maneuvers that are being executed to circumvent the sentence.

In practice, this tight control over schools also means a ban on those responsible for schools who do want to apply 25% Spanish.

It should be remembered that the Prosecutor's Office warned the directors that they could incur criminal liability if they did not apply the High Court ruling.

The Government points out to the schools that they must apply what is dictated in its decree from the 2022-2023 academic year, despite the fact that the TSJC demanded 15 days ago that next Wednesday, June 1, its sentence be applied in all the schools of Catalonia .
