The district court proceedings took place three weeks ago, when the prosecutor ruled that the farmer should be sentenced to responsibility for animal cruelty or a violation of the Animal Welfare Act.

Hudiksvall District Court announced at 2 pm on Wednesday that the person was acquitted of the charge of animal cruelty.

Lack of preliminary investigation

The district court justifies its ruling by stating that the prosecutor has presented a deficient preliminary investigation and writes, among other things:


“A requirement can be placed on the investigation that the prosecutor presents to the court is that all necessary investigative measures have been taken sufficient for a conclusion in the matter without reasonable doubt.

Defects in this regard shall not affect the accused but may be borne by the prosecutor. "

"Assumptions about crime"

The court considers, among other things, that the veterinary medical examination that has been made is substandard, among other things there is a lack of inspection of the respective animals and documentation of it.

This means that the court does not consider it robust enough for a conclusion without reasonable doubt.

"Nor is there any other investigation that shows anything other than the assumption of any crime," the court writes.


"Thus, there is no satisfactory investigation showing that a crime was committed according to the indictment."
