In the Catalan law of legal transition that the

Parliament of Catalonia

approved in September 2017, in the run-up to 1-O, the independence parties established 89 articles that should govern the proclamation of secession.

One of the most controversial regulations was the "law of the judiciary and the administration of justice" that converted the

High Court of Justice of Catalonia

into a Supreme Court of the

Catalan Republic

and whose president, as well as those of each jurisdiction, would be appointed by the president of independent Catalonia, at the proposal of a mixed commission between politicians and judges.

The norm, which was not applied when declaring the disconnection laws unconstitutional, was one of the most controversial approved by the independentistas since it directly attacked the

separation of powers

in a rule of law, the same thing that sovereignism accuses to Spain.

However, the former president of the Generalitat, C

arles Puigdemont

, has not forgotten about the project of judicial intervention since in the presentation of his plan for the government of the Consell per la República, an

alternative

body to the Government from Belgium, he has proposed to create a body of mediation to which its associates, all independentistas, will be able to avail themselves.

It is a "republican court" that pretends to be the "embryo" of a future

Catalan "

Judicial Power of the Republic ".

The vice-president of the Consell, the MEP

Toni Comín

, explained "we want the Consell to first think about and design a mediation body that those registered with the CxR can take part in, and that it therefore begin to act as a republican court, to put it in some way way, this embryo of the Judiciary, but from the logic of mediation and conflict resolution".

Therefore, in the coming months this court will be designed and the way in which the members of the body will submit to end disputes.

It will not be the only action of the Consell that intends to draft an "electoral law" for the Catalan Republic and create a "think tank" that contributes to deploying, from the field of studies, the strategy of this alternative body.

Carles Puigdemont considers that it is a "republican institution and we must make it grow. The Consell and the Assembly of Representatives have indisputable legitimacy".

That is why he considers that, after the Consell per la República and the Assembly of Representatives, he must create the judiciary to have the

three levels

of a modern democratic state, despite the fact that the country is physically lacking.

At the Consell meeting, it is also intended to carry out actions in Catalonia with members of the local councils and legally advise teachers who want to disobey the application of the ruling that orders 25% of Castilian in the classrooms of the community.
