The eight months of existence accumulated by the Mixed Group of the Madrid City Council, made up of three former mayors of Más Madrid, can only be understood from the intensity.

Already its formation, back in September 2021, sparked controversy due to the approval of the legal services of the Cibeles Plenary, dismissing the appeal presented by the formation led by Rita Maestre and now it has returned due to the dissolution sentence of the Madrid Justice.

Its creation already started a judicial war raised by Más Madrid and by Vox.

Both formations presented a contentious-administrative appeal

to dissolve the group created by the four councilors of Recupera Madrid, which finally remained in three after the resignation of Felipe Llamas and who would end up being a key support for the municipal government of José Luis Martínez -Almeida

to approve the Mobility Ordinance, the 2022 Budgets and the Terraces Ordinance

, three key projects during this last year.

On Monday, the Contentious-Administrative Court number 30 of Madrid took a further step in it by accepting the appeal of Más Madrid and

requesting the dissolution of the Mixed Group for considering its formation "not in accordance with law"

since Más Madrid, according to the sentence, "he attended that electoral appointment [that of May 2019] as a political party since as such it had previously been legally constituted" and "it had already acquired its own legal personality with such consideration."

Because that was the argument put forward by Recupera Madrid for its split: that Más Madrid was not a political party at that time.

Now it is the three mayors who have 15 days to appeal this sentence, as they announced yesterday that they would do while taking action

by taking their former municipal group to the Prosecutor's Office for "illegal financing and forgery of signatures on public documents."

“The resource will allow the fund to be valued, which demonstrates the instrumental nature of the party and therefore the viability of the Mixed Group,” they assured yesterday from Recupera Madrid in a statement

announcing the legal actions against Más Madrid for “collections of illegal quotas' and 'forged signatures'

with recently collected 'evidence'.

And, while the judicial war is unleashed, what happens to the Mixed Group?

As it is a contentious-administrative ruling and an appeal is filed, it is normal for everything to last a few months until almost the end of the legislature, in May 2023. Legal sources indicate that

Más Madrid could request the execution, but it would be «a remote possibility » That the judge proceed to the immediate dissolution

because the damage would be «more serious» if it had to be reversed a posteriori if the new appeal is successful.

That would lengthen the lives of José Manuel Calvo, Luis Cueto and Marta Higueras as their own municipal group, as has happened over the last eight months, where they have presented themselves as fundamental support for the municipal government in key projects at the end of the legislature after the approval good of the municipal legal services.

It is precisely to them that the municipal corporation will go again, which will have to pay the costs of the process if the sentence becomes final, to decide whether to appeal it or not.

«Mrs. Maestre must be used to making decisions without taking into account the legal services in the previous Government.

The decision to appeal does not correspond to the mayor, it corresponds to the legal services

depending on what they determine of the content of the sentence.

It is not a question, it is a technical question and we are going to abide by what our legal services determine, ”said the mayor of the capital, José Luis Martínez Almeida, yesterday, after the inauguration of the Madrid Gastrofestival.

These statements by Almeida responded to previous ones in which Rita Maestre stated that the case "makes it very clear" that

the alderman "fomented and encouraged turncoating for his personal interests" and

in which he asked her not to resort and "stop spending public money for his personal ends.
