The Islamic Call Organization is waiting for the Eid al-Fitr holiday to end until it resumes its activities from its headquarters in Khartoum, after the Supreme Court in Sudan ruled to invalidate the decision of the committee to dismantle the frozen regime of June 30, 1989, which dissolved the organization and canceled its registration nearly two years ago on charges of being linked to the ousted president’s regime. For two years, the Islamic Dawa Organization began its tasks from a temporary headquarters in Niger, and the organization formally signed an agreement with a presidential headquarters in Kampala with the Ugandan government in April 2021.

It will not be easy for the organization to carry out its activities in Sudan in light of the audit requirements of dozens of its subsidiaries, multiple bank accounts, as well as huge assets that were under the management of the dismantling committee.

Awatef Al-Jaali, a member of the legal team that defended the organization before the Sudanese judiciary, told Al Jazeera Net that "the next step will be after Eid Al-Fitr through the court, which will issue letters to the concerned authorities asking them to return the headquarters and companies to the organization."

Yahya Adam, Deputy Secretary-General of the Islamic Call Organization, confirms the court's decision to lift the restrictions that had hampered the organization's activity in Sudan, and pledged that the organization would begin its work after the Eid holiday by taking over its headquarters and assets.

Adam tells Al Jazeera Net that "the organization will address the Ministry of Finance, which confiscated the assets by order of the dismantling committee in order to return them, and then the organization begins its activity."

In a press release issued by the organization's headquarters in the Nigerian capital, Niamey, last Thursday, the organization presented its annual performance in African countries, and regretted that it was absent from Sudan for the second year.

According to the Secretary-General of the organization, the organization's fixed and mobile properties suffered great losses, in addition to significant damage to projects, furniture and files.

He explains that the organization, after receiving its headquarters and property, will conduct reviews through teams from the organization and the government represented by the Ministry of Finance, to determine the damages and cases of loss of movables due to negligence and mismanagement.

Asset review

Yahya Adam adds that the court's recent decision grants the organization the right to claim compensation in the event the review committees reach to determine the losses, saying that the organization is keen to preserve donor funds.

Awatef Al-Jaali confirms that the court will address the Ministry of Finance and the Commercial Registrar “to return the headquarters and property, as well as to reconcile the situation of dozens of managers appointed by the dismantling committee as directors of 87 companies affiliated with the organization, most notably the Danfodio Group, schools and kindergartens, the African Council for Private Education, the Riyadh Center for Media Production and Children’s City.”

She points out that the large number of companies owned by the organization, assets, bank accounts and agencies associated with international companies, requires a comprehensive review to consider compensating the organization for any losses resulting from the decisions of the dismantling committee.

Among the movables owned by the Islamic Dawa Organization are also about 400 cars, 40 cranes and a large number of agricultural machinery.

Compensation notifications

Al-Jaali reports that after the court's letters to the competent authorities, the organization's lawyers will prepare letters for the "Review Committee of the Dismantling Committee", which was formed by the President of the Sovereignty Council and the Commander of the Army, Abdel Fattah Al-Burhan, following the procedures of last October 25, in order to conduct the necessary reviews.

It considers that the court's decision ruled that everything should return to what it was before the decision of the dismantling committee was issued on April 11, 2020 to dissolve and cancel the registration of the Islamic Call Organization, and to confiscate its property and assets.

Al-Jaali notes that if the state of the headquarters and assets are different from what they were on that date, the organization's lawyers will file complaints and criminal procedures against the dismantling committee so that the organization whose status requires preserving donor funds can be compensated.

When the organization was dissolved two years ago, its supporters argued that it is a regional organization, and Sudan is just a headquarters country, and accordingly the government cannot confiscate its property and assets.

Abdul Rahman bin Abdullah Al Mahmoud, Chairman of the Board of Trustees of the Islamic Call Organization, welcomed yesterday, Friday, the decision of the Supreme Court in Sudan to invalidate the decision of the committee to dismantle the frozen regime of June 30, 1989.

Stressing that the legal team of the organization officially received the court's decision.

Al Mahmoud told Al Jazeera Net that "the organization will begin, as soon as the legal procedures are completed, to receive its headquarters, property and endowments, to provide its humanitarian services to all needy segments of Sudanese society without discrimination."

He affirms that the organization will continue its legal procedures to compensate it for the moral damage caused to its reputation, assets, and the dues of its employees who have been displaced for more than two years.

It is noteworthy that the Islamic Dawa Organization (Mada) was established as a regional organization in 1980, and its headquarters is in the Sudanese capital, Khartoum. It has 4 regional offices in Africa, and provides humanitarian and voluntary services in about 40 African countries.

The organization has 33 missions in Africa, working in the areas of health, education and sponsorship of orphans and homeless.
