A Gulf man expels his ex-wife's mother from the nursery house in the "court"

Khaleeji filed a personal status case in the Fujairah Court of Appeal, demanding that his ex-wife and her mother be obliged to leave the nursery house owned by him, on the basis that he wanted to sell it.

The court of first instance rejected the case, and the verdict was not accepted by the plaintiff, so he appealed it. After the case was discussed, the court ruled to expel his ex-wife's mother from the nursery residence.

In detail, Khaleeji filed a lawsuit, in which he stated that the defendant was his wife, and disagreements occurred between them, as a result of which she filed a divorce lawsuit, and a judgment was issued for her to divorce, and the legal rights established after the divorce. Her stay in his house has become unlawful, and he does not wish to keep her and her mother in the dwelling owned by him.

The rationale for the judgment of the Court of Appeal came that it is decided that the trial court has the complete authority to understand the reality of the case and assess its evidence, and there is no comment on that as long as it does not reconcile with an unsubstantiated fact, and it is sufficient for it to show the truth that it is convinced of, and to base its judgment on justified reasons. Nor does it have to follow the opponents in their various statements, arguments and requests, and to respond independently to every statement or request they raised, as long as the truth that it was convinced of and cited its evidence in is the implicit response that dropped those statements, arguments and requests.

The court stated that the appellant did not come up with anything new that would change the face of the opinion in the case, as long as the appeal was not based on a valid legal basis, it should be rejected for the appellant.

The Court of Appeal decided, in presence, to accept the appeal in form, to cancel the appealed judgment in what it had decided to reject the case for the first respondent or his ex-wife, and to rule again by forcing her to leave the nursery residence.
