After Óscar's statement on April 25, the private prosecution, on behalf of the victim's family, requested the adoption of the precautionary measure of provisional detention, communicated and without bail or, alternatively, a bail of 60,000 euros, in addition to request that his detention be agreed for a period of 72 hours.

Both the prosecutor and the defendant's defense opposed the adoption of these measures, after which the judge, "fully" sharing the report of the public ministry, decided that at that time it was not appropriate to access those requests.

In the legal reasoning section of the order, it argues that "there is no account of how the events occurred, what exists are indications or suspicions that force us to continue investigating" the disappearance and violent death of Esther.

The judge also states that the person under investigation cannot interfere in the investigative proceedings that are being carried out by the Civil Guard, nor does he have access to the cloud of his phone, currently intervened and in the hands of the agents.

The order establishes that the suspicions that may fall on the investigated "are not enough to adopt such serious measures", since "there is not even a factual account of what could have happened in the case, and the investigated has personal, family roots and work, has collaborated with the agents, attended the police appeal and has also appeared at the judicial appeal" last Monday.

Following the decision of the judge dated April 25, the parties in person may file an appeal for reform and subsidiary appeal within three days of notification, or appeal directly within five days of notification. .
