“The Investigative Committee of Russia opened a criminal case against the deputy commander of the 56th separate motorized infantry brigade of the Armed Forces of Ukraine, Lieutenant Colonel Dmitry Gerasimenko, as well as other unidentified persons from among the military personnel of this brigade.

They are suspected of committing a crime under Part 1 of Art.

356 of the Criminal Code of Russia (“Ill-treatment of the civilian population, the use of prohibited means and methods in an armed conflict”),” the statement says.

It is specified that Gerasimenko and his accomplices carried out deliberately criminal orders of higher commanders and officials of the Ministry of Defense of Ukraine.

In doing so, they violated the provisions of the Convention for the Protection of Civilian Persons in Time of War and Additional Protocol II.

In particular, according to the investigation, Gerasimenko, along with other servicemen, shelled Donetsk on April 24, as a result of which a 71-year-old civilian was wounded, and houses and other buildings were damaged.

Earlier, the head of the Investigative Committee of Russia, Alexander Bastrykin, instructed to open a criminal case on the fact of the shelling of the village of Nekhoteevka in the Belgorod region.
