Morocco is preparing to put in place a legal framework that would grant a mother the right to prepare a passport for her minor children without the father's prior express consent.

This approach comes, according to the Minister of the Interior Abdel-Wafi Laftit’s answer to a parliamentary question to address the difficulties faced by Moroccan women living abroad, especially divorced women, to prepare official identification documents for their children, such as the passport and the national identity card inside or outside the country, due to the refusal of parents to prepare such documents. documents.

The Ministry of Interior said that the father's consent would be implicit unless the father of the minor child asked the court to issue a decision preventing the mother from obtaining this passport without his consent.

In the event of a conflict between parents, this requires recourse to the judiciary.


The Ministry of the Interior added that pending the development of the legal framework, the Ministry of Foreign Affairs, African Cooperation and Moroccans Residing Abroad allows its consular interests to grant the custodial divorced mother the right to request and withdraw the passports of her children in the absence of the father and it is impossible to contact him.

She explained that the implementation of this procedure comes to take into account the interest of minor children, especially since the issuance or renewal of the passport is a prerequisite for renewing residence in the home of the diaspora and the completion of other services, as well as maintaining the connection with the mother country.

The same ministry revealed that this procedure takes place after the consular authority contacts the father if he is registered with it, or it can contact him to urge him to do the required thing within 15 days.

The Ministry of the Interior noted that “after the expiration of this period without a response from the father concerned, or if it is not possible to contact him by the consular authority, the passport can be accomplished based on a statement of honor issued by the mother regarding the interruption of contact with the father and the impossibility of communication with him, or based on a judicial decision from the authorities The country of residence if she prefers to go through this procedure.
