The name of the late Egyptian President Hosni Mubarak has returned to arouse controversy again, after the General Court of the European Union decided to cancel the decisions to freeze his and his family's funds that were previously taken by the Union Council.

Egyptians argued on social media between supporters of Mubarak, who considered the decision an affirmation of the integrity of the late president, and opponents who said that the cancellation decision came as a result of the Egyptian authorities' negligence in pursuing what they described as money smuggled abroad, while others questioned the source of those funds and how Mubarak and his family obtained it.

Yesterday, Wednesday, the court's official website reported that it had canceled the 2011 European Union Council decision, which had been renewed until last year "on the restrictive measures directed against certain persons, entities and bodies in light of the situation in Egypt."

The decision included canceling the restrictive measures against Suzanne Thabet, the wife of the late president, Gamal and Alaa Mubarak, and their wives, Heidi Razek and Khadija Al-Jammal, which means that the freeze on their funds was lifted.

The court also ruled that the Council of the European Union should bear the litigation costs incurred by the Mubarak family.

It did not disclose on its website the amount of funds that will be lifted, which will be available after the 70-day period for appealing the court's decision.

The family hopes for compensation

In turn, the Mubarak family announced that it had received a large sum of money from the Council of the European Union, and is awaiting other funds from it, after a European ruling was issued to lift the freeze on its funds.

Alaa Mubarak said, through his documented account on Twitter, "The General Court of the European Union presents a new and unequivocal judicial recognition that the sanctions imposed by the Council of the European Union on President Mubarak and his family were illegal from the beginning, ending a decade-long legal battle."

The late president's son attached his tweet with an electronic link to a statement issued by the British law firm "Carter Rock", which advocates for his family.

He added that his family "suffered severe damage to their reputation due to illegal European sanctions," explaining that they had already received a large amount from the Council of the European Union as a reimbursement of legal expenses, without specifying its value, expecting to receive more money from the Council of the European Union in accordance with the court order.

It seems that the Mubarak family hopes to obtain compensation, as Alaa said that he asked his legal advisor to study all possible legal ways to obtain compensation from the Federation Council, as a result of "the illegal measures that were imposed on my family over the past years."

Corruption accusations

This is not the first European ruling in favor of the Mubarak family regarding its frozen funds, as similar decisions have been issued in recent years.

In March of last year, a decision was issued to cancel the sanctions imposed in 2011 on 9 Egyptians, including the Mubarak family, on suspicion of stealing state funds.

A month after the January 25, 2011 revolution overthrew Mubarak (1981-2011), the European Court of Justice decided to freeze his funds and members of his family in Europe, on the grounds that they might revert to the government in light of cases inside the country accusing them of financial corruption.

There is no accurate estimate of the size of the Mubarak family's money or their whereabouts, and the family has not announced any data in this regard.

On January 9, the Egyptian Court of Cassation (the highest civil court) rejected the second appeal submitted by Mubarak and his two sons to their three-year prison sentence in the corruption case known in the media as "presidential palaces."

The ruling included a joint fine of more than 125 million Egyptian pounds (about 15.96 million dollars at the time) to the three and also obligating them jointly to return more than 21 million pounds to the state's public treasury.

The ousted president died in February 2020 at the age of 91.

Congratulations were poured out on Alaa, the eldest son, in response to his tweet in which the news was announced, and a number of well-wishers said that they did not doubt for a moment that the sanctions were political, and some of them praised the period of the late president's rule and the stability it witnessed, according to them.

While a third group focused on what happened as a result of the laziness of the authorities, and the reluctance of the Egyptian judicial authorities to defend the Egyptians' money.
