Al-Khayyat told «Emirates Today» that Article 43 of the old Law No. 8 of 2016 stipulates that a criminal case shall not be instituted against the abuser of narcotic substances or psychotropic substances if the abuser submits spontaneously, his spouse or one of his relatives up to the second degree to the addiction treatment unit or The Public Prosecution Office or the police, requesting his deposition for treatment with the unit, and he shall be deposited with it until the unit decides to remove him.

The second clause of it stipulated that “in cases where the deposit is not from the Public Prosecution, the depositing authority must obtain the approval of the Public Prosecution when depositing the drug, expulsion, non-compliance with the treatment plan, or failure to hand over the narcotic substances he obtained, to take the necessary action regarding the filing of the case. penal.

He stated that he does not benefit from the exemption if the unit decided not to adhere to the prescribed treatment plan, and in all cases, the period of treatment, rehabilitation and care may not exceed two years.

Al-Khayyat explained that this article was separated into three articles in the new law No. 30 of 2021, adding articles 89, 90 and 91 fundamental amendments that provide greater opportunities for the category that shows a sincere willingness to recover from this devastating disease.

He pointed out that Article 89 stipulates that “the criminal case shall not be instituted against the abuser of narcotic drugs or psychotropic substances, if the abuser spontaneously, or his spouse, or one of his relatives up to the second degree, or who is responsible for his upbringing, submits to the unit, the Public Prosecution or the police prior to his arrest, or Before a warrant is issued for his arrest, they demand that he be deposited for treatment with the unit, so that he is deposited with it until it is decided to release him.”

Al-Khayyat pointed out that the legislator added the category of those who raise the drug user to the relatives who can help him recover and be exempted from legal accountability. The amendments in the same article also included that the period of treatment and rehabilitation may not exceed one year, instead of two years according to the old law. It gives him the opportunity to recover quickly and integrate into society.

He explained that Articles 90 and 91 dealt with other details that were included in Article 43 of the old law, including in Article 91 that in the event the applicant does not adhere to the treatment or rehabilitation plan or violates the controls followed in the treatment unit, the supervising committee issues a report explaining the violations, and it is submitted to the Public Prosecution for action In this case, the court shall order his imprisonment for a period of no less than one year, and the period of deposit shall be deducted from the period for which he was sentenced.

Al-Khayyat stressed that the aim of these materials is to help everyone who expresses their desire for treatment to recover, pointing out that he can benefit from them more than once, and once treatment is requested, whether by him or the aforementioned groups, a criminal case is not filed against him.
