No one understands how the father was not prohibited from contact with the child.

María Dolores and José Antonio filed a

divorce petition by mutual agreement

in July 2021 in the Sueca Family Court, with a regulatory agreement with shared custody regarding the minor, as reported by the Superior Court of Justice of the Valencian Community.

A month later, in August, the court with jurisdiction in matters of violence against women, held a quick trial against José Antonio and sentenced him, as the perpetrator of a

crime of mistreatment,

to 40 days of work for the benefit of the community, 8 months of separation [until this month of April and prohibition of communication with respect to his ex-wife, in addition to 16 months and 2 days of prohibition of possession of weapons.

That sentence, of August 12, is issued by agreement of the parties and is, therefore, final.

The ruling established that custody and parental authority rested with the mother and

suspended any visitation regime

, in addition to setting an alimony of 200 euros.

However, in September, both spouses ratify the regulatory agreement presented in July in the Family Court, without any communication of the existence of a criminal proceeding for ill-treatment and of the sentence passed.

There was no judicial coordination nor did the parties report

the impossibility of establishing the agreed visits.

No threats to the minor

“He annulled her, tried to take her away from her family and then physically abused her.

Even so, she had the power to make him believe that she was a good person and that she loved her son, "says Marta Tur, still not believing what happened.

"She had shown obsession with my cousin in recent months and on many occasions we have felt fear, that's why we accompany her to file the complaint."

Fear for the mother, although the

legal risk rating was "slight"

, but not for the child.

“Inside the monster that she was, she had never yelled at him.

There were never any threats to hurt him.

With the child he is the only one with whom she behaved like a somewhat normal person, "she added.

Even so, this visitation regime was not strictly adhered to.
