Association of Prosecutors
(AF) considers "unacceptable" the PSOE amendment that will automatically promote Dolores Delgado to the highest category of Chamber prosecutor when she leaves the
State Attorney General's Office
.
In his opinion, it is a "prize" from the
Government
.
"We understand that the purpose of carrying out the reform in a hasty and silent manner denotes the interest in directly benefiting the current Attorney General of the State, giving her a way out of the termination of her mandate, ultimately creating an
ad hoc
solution , which cannot be the ultimate goal of a standard", states the majority association in the race in a statement.
"We consider it unacceptable that such a far-reaching modification be introduced, without publicity and robbing
the Fiscal Council
and the General Council of the Judiciary, as well as the associations of prosecutors and, in general, the entire
Prosecutor's Career
, of any possibility of claiming it ", explains the AF, referring to the fact that the system used for its approval - an amendment to the
Bankruptcy Law
- prevents the aforementioned bodies from obtaining a report on the reform.
The association chaired by
Cristina Dexeus
places what happened in a broader framework that in her opinion deserves "deep reflection", which is that of the requirements to be appointed attorney general.
And they add another drawback of the reform: that it supposes "the direct involvement of the Government" in the formation of the highest category of the Prosecutor's Career, because it allows it to directly promote a prosecutor to its highest category, which is currently not possible.
As for the justifications that the Minister of Justice, Pilar Llop, offered yesterday, the statement states that "it is not true" that the
Group of States against Corruption
(Greco) of the Council of Europe has demanded this measure from Spain.
There are other reforms that have been requested and that have not been adopted by the Government, according to the prosecutors of the AF.
In addition, the AF recalls that in 2018 Delgado, when she was Minister of Justice, tried to include an "identical provision" to that of the PSOE amendment in the draft
Regulation of the Prosecutor Career
, "which led to unanimous disapproval" of these professionals.
According to this association, a majority of prosecutors considered that "a reform of such depth should not be introduced through regulations but by reforming the
Organic Statute
of the public prosecutor's office without ruling on the advisability or otherwise of such promotion, an issue closely linked to the requirements to be appointed Attorney General of the State, of which we are currently being deprived".
