  • Courts Prisoners of ETA deny that their lawyers transmitted communications from the band to them

The National High Court has sentenced the lawyer for ETA prisoners Arantza Zulueta to seven and a half years in prison for being herself part of the terrorist organization and for depositing weapons and explosives.

The sentence considers that, as a member of the structure called Halboka, she was part of the legal front of ETA, whose essential purpose was to control the prisoners of the gang.

The court also sentenced lawyers Jon María Enparantza

(four years),

Naia Zurriarain

(three and a half years) and

Iker Sarriegi

(three years and one day)

for integration into a terrorist organization .

The penalties could have been higher, but the court has appreciated the mitigation of undue delays in the procedure.

Three other defendants have been acquitted for lack of evidence.

They are

Julen Celarain, Saioa Agirre

and

Nerea Redondo

.

According to the Court, throughout 549 pages the sentence details the role of the defendants in the Halboka structure, which came to replace the so-called "prison front" or "Makos front" and which, according to the Chamber, is a fully integrated into the terrorist group ETA.

The court details that within Halboka there is a legal front that includes lawyers who, apart from the legal defense of the members of ETA, "maintain their links with the leadership of the terrorist organization and transmit the guidelines this".

The sentence explains that the four convicted lawyers operated in favor of ETA from two legal offices, located in

Bilbao

and

Hernani (Guipúzcoa)

.

"Each one from their respective professional skills and respecting the affiliations assigned by ETA, made their services available to the terrorist group, from whose locations they sent and received orders, as well as dealing personally with other active members and leaders of It, in order to seek the best knowledge of its affiliates deprived of liberty or who have gone through that trance, in order to gain their trust and consideration in order to remain closely linked to the terrorist organization through bonds of union that externalize internal cohesion and unity of criteria".

"Targets to attack"

In other cases, adds the Chamber, "they identify and point out possible actions and objectives against which to attack and contribute to the collection of the so-called "revolutionary tax" basic for the maintenance of the varied structure created over the years."

The sentence explains that the facts declared proven appear accredited after the evidence practiced in the trial with the statements of the accused, the testimonies of the Civil Guard officials, the expert opinions and especially the accumulated documentation extracted from the computer devices seized in the entries and records made.

For this reason, the court concludes that the actions of the four lawyers fit into the crime of integration, "when it was revealed that the four participated in the goals of said terrorist organization and were active in it, not directly committing violent actions but contributing to the cohesion and persistence of the militants deprived of liberty, so that they continue to be linked to the criminal organization that gave them cover to commit the illicit acts against people and against property that they perpetrated or tried to commit at the time".

The court rejects the argument of the defenses that the activity of the accused never transcended the legal scope derived from their activities.

For the Chamber, the evidence has been obtained through a multitude of logical inferences and the effects and documents found in the records, which basically reflect, according to the ruling, "an activity related to ETA's objectives to cohere messages and control the movements of its militants and former militants subjected to investigation, prosecution and serving sentences".
