The European Public Prosecutor maintains that the decision of the State Attorney General, Dolores Delgado, to keep the Anti-Corruption Prosecutor in charge of the investigation into Isabel Díaz Ayuso's brother "does not comply" with EU law and announces that "it will continue your investigation".
According to the statement issued this Wednesday by the institution, the decision of the Attorney General's Office is "a challenge" to its "supremacy of European regulations" and the "exclusive mandate" of the European Public Prosecutor's Office to ensure the correct interpretation of the Law of the EU.
The European Public Prosecutor's Office also expresses its "concern" about the procedure used to resolve the conflict of powers, since it has been adopted by the Attorney General, "who is the hierarchical superior of the national body and, therefore, partial in the ongoing procedure ".
He considers that the decision made after listening to the Board of Prosecutors has been made "without listening to both parties" and that Spanish law "does not provide" how to appeal such a decision.
