The head of the family prosecution in Abu Dhabi, Mohammed Rashid Al-Dhanhani, stressed during the monthly media forum at the Judicial Department, yesterday, the difficulty of determining the extent of the problem of domestic violence, due to the failure to report most cases “as a personal, family problem, which should not go beyond the walls of the house”, as well as Because of the fear either of the aggressor himself, or because of the woman’s fear of the disintegration of her family, or the fear of society, due to the prevailing customs and traditions.

Statistics showed that violence against wives came to the fore in the 380 cases of violence in 2012.

As for the cases that occurred from parents to their children, or vice versa, and were presented to the family prosecution during 2012, their number reached 183.

At the top of the list of complaints were cases related to parents' notification of their children's absence from home.

As for the cases that occur from siblings within the family, the crime of assaulting the integrity of the body was one of its most important manifestations, followed by the crime of slander and insult, and finally the crime of threat.

He pointed out that there are no laws specific to domestic violence, but rather protection provided by scattered legal texts in the Penal Code, as ordinary crimes and not crimes of domestic violence.

Al-Dhanhani defined domestic violence as “the behavior of a family member that causes material or moral harm or both to a member of the family, and this specifically means all kinds of beatings, imprisonment of freedom, and deprivation of basic needs. towards her husband, parental violence towards children and vice versa, as well as violence against an unmarried girl practiced by her brothers or her father, confiscation of her rights to continue her studies, indifference to her opinion regarding marriage, and confiscation of her freedom.

He explained that by studying and analyzing the contents of the cases and complaints received by the family prosecution, it was found that physical violence is the most prevalent type of violence, and it includes all kinds of beatings, and offenses of cursing, cursing and threatening, in addition to parental neglect of child care, which leads to serious injuries that may lead to His death, in addition to sexual violence such as rape, indecent assault, intimidation, exploitation, indifference and imposing opinions on others, contempt, expulsion and forcing to do an act against the individual's desire, stressing that prejudice to feelings, undermining rights, confiscation of opinion and dealing with disrespect are a form of violence against women.

Al-Dhanhani pointed out that the most important causes of domestic violence between spouses are the loss of respect between the spouses, and the persistence of insulting each other, which irritates the husband, and then attacks his wife by beating, insulting and threatening.

The list of reasons also includes the disturbance of the relationship between spouses from neglect of marital duties, including the husband’s failure to satisfy his wife’s emotional and material needs, as well as the woman’s going out to work, which led to the wife’s failure to perform her marital duties, the husband’s jealousy of his wife, and the dependence of some husbands on the wife’s salary. In some cases, the husband pushes the wife into debt, which also affects the marital relationship and leads to violence between the spouses, in addition to the wife’s infidelity, which is a major cause of division between the spouses, as well as the abuse of intoxicants such as drugs and alcohol.

The wife’s female friends, especially those who are divorced, also have a significant impact on the marital relationship, as the wife seeks to imitate them, which raises tension in the marital relationship, and generates husband violence towards his wife.

As for the reasons for the spread of violence between parents with their children, they include neglect in the care of children, the lack of mutual dialogue between the son and his parents, escaping from family problems at home, as well as the weak control of parents over the programs broadcast by channels that broadcast extraneous cultures on our society such as pornography of love and relationships. Forbidden, incestuous pregnancy, living with a friend in one place, and other strange habits, as well as the spread and abuse of social media.

As for the cases of parental abuse of children, it turns out that most of them are caused by the separation of the spouses, as each party resorts to assaulting its children in retaliation from the other party, preventing the child from communicating with him, and other cases in which the cause of the abuse was discipline, where the parents use this right to waste, what This resulted in severe injuries to the child, and in some cases it led to death.

Al-Dhanhani recommended, in the paper he presented at the forum, the need to find special laws regulating the issue of domestic violence, based on the principles of the true Islamic religion, which ordered respect for human dignity and the preservation of human rights, provided that these laws include provisions for reporting and procedures to be followed by not limiting the right to Reporting the crime of domestic violence against the victim or the injured person, but this right is recognized for everyone who comes into contact with him, and it has made reporting cases of violence, especially against children, mandatory for everyone who has knowledge of this violence, and arranging a punishment for anyone who violates it.

The recommendations stipulated that domestic violence laws should specify the procedures to be taken to ensure that the necessary protection is provided to the victim when reporting violence against a child or woman by removing the offender from the home, or by transferring the victim to a shelter designated for this purpose, and establishing institutions Concerned with the family, protecting children and women to reduce family violence, providing services to women and children who are subjected to domestic violence, and assisting in the rehabilitation of the perpetrator of domestic violence, with the establishment of a place designated for women or children, who reported violence they are exposed to within the family, pending the completion of procedures Litigation to avoid collision with the offender again after reporting him and repeat the abuse again, and attention to the aftercare of children who are exposed to family violence by institutions concerned with the protection of children and women, so that they take care of the psychological and mental aspect of the child or woman, to try to remove the bad psychological effects left by themviolence.

The paper also recommended that the laws on domestic violence include the provision of a set of measures in cases of violence that do not reach the rank of crime, and penal laws are not applied to them, such as referring the accused of a domestic violence crime to a rehabilitation center, subjecting him to rehabilitation and training programs, and in the event of return. The accused shall be punished with the penalty of a community service order, and the court shall decide the duration, place and quality of service, according to the degree of the crime and the offender's qualifications.
