The National Court, whose plenary had agreed to the delivery, has suspended the execution after receiving a notification from Strasbourg informing of the filing of a lawsuit by Carvajal and the decision to apply the precautionary suspension.

"Given account, by receiving communication from the European Court of Human Rights on the day of the date, it is agreed to suspend the execution of the extradition order of the claimed Hugo Armando Carvajal Barrios by virtue of article 39 of its Regulations," it says. the ruling of the

The Third Section, which had previously protested the delaying maneuvers of the former head of military intelligence with Nicolás Maduro, has been forced to agree to the postponement again.

The precautionary suspension comes in the same week that the

Ministry of the Interior

had reported that it had rejected the second request for asylum presented by Carvajal.

The United States asked Spain to hand over the soldier, considering that he participated in sending huge amounts of drugs to that country when he was still part of the Chavista regime, with which he ended up breaking.

Delivery postponed again

The administrative and judicial hyperactivity of Carvajal has been postponing for some time a delivery that was expected to be imminent last September, when after almost two years on the run he was arrested in an apartment in Madrid.

The Venezuelan soldier had gone into hiding when he learned that the Full Court had revoked the court's initial refusal to hand him over to the US.

Carvajal has argued -successfully.

deficiencies in the processing of the handover, as well as submitting a second asylum application, a procedure that by itself prevents the handover from materializing.

He has also appealed administratively, in the High Court and in the Supreme Court all resolutions on his case, which have always been contrary to his interests.

Now it will be necessary to wait for Strasbourg to rule on his case before reconsidering the delivery.

Meanwhile, Carvajal will be able to continue offering the Audience information on alleged irregularities in the financing of the founders of Podemos by Chavismo, as well as other data on terrorism to which he would have accessed thanks to his position in the regime.

Carvajal agreed to testify about all this to try to stop his extradition.
