The appellants questioned the power of the court to set this percentage and remarked that the court decision "sacrificed the right of some thirty students" to receive classes mostly in Catalan.

They also highlighted that the use of languages ​​in the center was marked by the linguistic project approved by the School Council in 2019 and that the European Charter for Regional or Minority Languages, signed by the State in September 2001, must be taken into account. in which he commits himself to "making possible an education in the regional languages".

However, the TSJC recalls that "the judgment of December 16, 2020 in reference to the educational system as a whole has become final" and points out that "the Constitutional Court has reiterated on several occasions that the linguistic conjunction system is a constitutional imperative and that the same necessarily entails the vehicular use of both official languages, without the users of the education service being able to recognize a subjective right to choose language or vehicular monolingual teaching.An approach that coincides with what was resolved by the Court European Court of Human Rights in the judgment of July 23, 1968 mentioned by the appearing parties".

In addition, it indicates that "no damage to the students of the affected course can be identified due to the application of the linguistic conjunction system to the extent that this circumstance does not violate any possible subjective right that they may have against the education system."

That is why he rejects the appeal of the families.

From the Assembly for a Bilingual School (AEB), which this Wednesday has called an act in Barcelona to demand the application of 25% of Spanish in the classrooms, recall that the TSJC has recognized "the obligation that the 2 languages, Catalan and Spanish , be vehicular".

In addition, they explained that the court has ordered new precautionary measures in two other centers, located in Vallés and Baix Llobregat, so that they apply a minimum 25% of classes in Spanish after requesting it by some families.

However, the judicial decision affects a class and not only a center, since the TSJC considers that it should be requested in the execution of the sentence of 25% in the entire educational system, according to judicial sources.

On the other hand, Òmnium Cultural will represent some parents of the Turó del Drac school in Canet de Mar in court since "it is a paradigmatic and country case".

"If someone thinks they can put the school at their service, they don't know Catalan society," said the president of Òmnium Cultural, Xavier Antich, adding that the objective of the pro-independence entity is "to succeed in invalidating all the rest of the sentences lawsuits that seek to attack the school in the same sense".

In addition, they urge "to invalidate every initiative that is tempted to break the Catalan school model, which is the consensus of the country and an example of cohesion and learning."
