Gran Vía, Puerta del Sol, Calle Alcalá, Plaza de España or Plaza de Canalejas

will be able to host new hotel and leisure establishments.

This has been established by the Superior Court of Justice of Madrid by annulling article 21 of the Special Acoustic Protection Zone (ZPAE) that limited the "new implementation, expansion or modification" for this type of business.

As stated in the ruling of March 9, 2022, to which EL MUNDO has had access, the Justice considers "partly" the appeal of the La Viña Hospitality Business Association and

nullifies that article on the review of the ZPAE

that the plenary session of the Madrid City Council approved on April 30, 2019.

That point of the regulation prevented new hospitality or leisure premises from being established "in a distance of less than 150 meters from an area of high noise pollution, less than 125 meters from an area of moderate noise pollution and less than 100 meters from a moderate noise pollution zone.

What is known as white areas

and which includes enclaves of the Central district such as Gran Vía, Plaza de España or Canalejas.

This ruling

also includes the streets adjoining the district that had acoustic protection zones in front of

them and that were affected by article 21. However, the Madrid Hospitality Association understands that despite this modification, a large part of the hospitality businesses in Centro they still have "very limited exercise of their activity" due to "very restrictive hours" and the "many limitations when it comes to improving premises or modifying licenses" imposed by the ZPAE.

This is one of the claims that hoteliers have made since the regulations were installed in the first quarter of 2019 with Manuela Carmena as mayor because they assured that their activity was limited and even so the noise was not going to decrease.

A vision that collides with that of the City Council, which pointed out in the modification of the norm that

the concentration of entertainment venues "does not meet the objectives of acoustic quality"

, which is why "specific zonal plans that allow the objectives to be achieved" should be developed. of acoustic quality.

"It was unreasonable that the Centro district, the most important and tourist district in Madrid,

did not allow service companies such as the hotel industry to improve their premises or open new gastronomic proposals

in those areas that are not affected by the ZPAE", affirms the president Hospitality Madrid, José Antonio Aparicio, through a statement from the association.

It also ensures that the court decision "is good for the sector, but also for the city of Madrid, which will see how companies, their services and the city's gastronomic offer improve."

The

disputes between neighbors and hoteliers in the center of the capital

have been continuous for years and have intensified even more with the pandemic.

The expansion of the terraces, now regulated by the new ordinance, was one of the most controversial issues since the merchants understood that it was essential to keep their business open while the neighbors complained about the excessive noise coming from them.
