The Provincial Court has sentenced a 35-year-old Dominican man to six years and six months in prison for sexually assaulting his best friend's girlfriend.

A period of supervised release of eight years

and compensation to the victim of 10,000 euros for the moral damages suffered

are also imposed .

The events occurred in the early hours of June 16, 2018, when the accused met the victim he knew as his best friend's romantic partner in a bar on Calle Topete de Tetuán.

At that time

, he invited her to a party that he said would be held at her house

and to which other people with whom he was having drinks at the aforementioned establishment would also attend.

Around 7:00 a.m. that day, the woman arrived at the defendant's apartment, and "realized that they were alone and that there was no party, so she tried to leave the house, not letting the accused leave," according to the judgment.

She tried to leave again, taking advantage of the fact that the defendant went to the bathroom

, "She was again detained, when she was already out of the apartment."

The victim told him that she did not want to have relations with him, "at which point the accused brandished a knife and approached her trying to put it on her neck", beginning a struggle during which the man even cut her slightly and triggered

"the defendant taking her to her room where he abruptly took off part of her clothes, lay down on top of her, grabbed her by the arms and entered her, even slapping her in the face," says the court resolution.

Complaint at the police station

Hours later, the victim went to report the incident at the police station and told what had happened to a friend by phone and to her boyfriend.

The defendant denied everything and stated "that they undressed each other

and there was vaginal penetration, without a condom; that he did not grab her or hold her; that when they finished, she got dressed and left" being the same one who "asked her for a taxi with his application" .

And he added that around 11:30 a.m. the victim's boyfriend appeared at his house and "they argued strongly to the point that the police arrived, notified by neighbors," according to the ruling.

The private accusation, led by the criminal lawyer Beatriz Uriarte, from Ospina Abogados, called the forensic experts to testify, who confirmed the bruises and the cut at the trial, which was reinforced with the victim's assistance report from the La Paz Hospital. , which stated that "he had a digital pressure mark on the left forearm and a minimal linear excoriation on the back of the left forearm."

there was no doubt in the victim's testimony

and it was ruled out that she could bear resentment, revenge or enmity in her testimony.
