The criminal chamber of the Court of Cassation rejected his appeal on Wednesday.
A little over a year ago, after several hours of deliberation, the Paris Assize Court, specially composed of professional magistrates, sentenced Abdelkader Merah to 30 years' imprisonment for "complicity in murder and attempted of assassination in connection with a terrorist undertaking" and "association of criminals of a terrorist nature".
This 36-year-old Toulouse man was then found guilty of having participated in the deadly journey of his younger brother, Mohammed, who in March 2012 shot seven people, including three children from the Jewish school Ozar Hatorah.
His lawyers then decided to appeal, pointing in particular to the anonymous testimony of a witness, or even the accused's knowledge of his brother's terrorist plans during the theft of the scooter, when Abdelkader Merah was present.
Two-Thirds Safety
"I simply wanted to say that I have nothing to do with the actions perpetrated by my brother", he had indicated with a Toulouse accent during his second trial.
His lawyer, Eric Dupond-Moretti, had tried in his argument to reduce the sentence: "If you condemn Abdelkader Merah, the terrorists will have won", he had pleaded.
