Colombians are going to have a new choice to officially define themselves.
A court has ordered the inclusion of the "non-binary" gender on identity documents in Colombia, according to a ruling handed down by the Constitutional Court on Tuesday.
These so far only mention the categories “man” and “woman”.
This new category should be an option available to Colombian citizens within six months.
For this decision, which will set a precedent, the Court ruled on the request of a 40-year-old person who, born a man, began a process of “gender transition” at the age of 20.
“A first step towards effective social participation”
In 2015, she changed her name to Dani Garcia and expressed her preference for the female gender.
In 2019, she demanded to be presented on her identity documents as being of “undetermined” sex, “her current appearance not completely coinciding with the social imagination on the characteristics of the female sex”.
The request was initially rejected by the National Registry, responsible for issuing identity cards in Colombia.
Following the applicant's appeal, the Court ordered the agency to give Dani Garcia a new document “which incorporates (…) in the sex category, the “non-binary” choice”.
“Configuring a new gender marker is a first step towards effective social participation,” the judges said.
