The former president of the Parlament and current director of Empresa Roger Torrent will sit in the dock for a crime of disobedience to judicial authority.

The Superior Court of Justice of Catalonia (TSJC) rejected the appeals filed by the former members of Parliament charged in this proceeding, Torrent, Josep Costa, Eusebi Campdepadrós and Adriana Delgado, against the court's decision three months ago to prosecute them for processing November 2019 resolutions in favor of self-determination and disapproval of the monarchy when the Constitutional Court had suspended them.

In this way, Torrent and the former members of the Board of the Catalan chamber of JxCat and ERC, Josep Costa, Eusebi Campdepadrós, current secretary of the Administration of Justice of the Generalitat, and Adriana Delgado, will sit on the bench and will have to face a penalty of disqualification for public office.

In its decision to conclude the investigation, the TSJC considered that there was a "set of indications" that "there is a reasonable and sufficient appearance that those under investigation could have committed one or more crimes of serious disobedience," sanctioned with a fine of three to twelve months and special disqualification from public employment or office for a term of six months to two years, for allegedly refusing to comply with judicial resolutions.

Allegedly, the defendants failed to comply "with their legal duty to prevent or paralyze any initiative that involves ignoring or evading the mandates of the Constitutional Court and despite warnings to the same effect from several parliamentarians and from the Secretary General himself in vocce, they manifestly disregarded what was ordered by the High Court, admitting these proposals for processing".

The resolutions promoted the exercise of the right of self-determination and the disapproval of the monarchy.

For this reason, the TSJC believes that the defendants gave "an appearance of legitimacy" to "a declaration of will with content analogous to those already annulled by the Constitutional Court."

In addition, they point out that the judicial decisions "were binding for the then president of the Chamber and the other members of the Bureau."

Now the Prosecutor and the accusations must present indictments.
