The warning effect is obvious, and the difficult problem of obtaining evidence is still to be solved - the observation of the first anniversary of the high-altitude projectile imprisonment

Xinhua News Agency, Chongqing, March 1 (Xinhua) -- The crime of throwing objects from high altitudes was officially sentenced in the "Amendment to the Criminal Law of the People's Republic of China (Eleven)", which took effect on March 1 last year.

Over the past year, whether the behavior of high-altitude parabolas has been significantly reduced, whether the difficulty of obtaining evidence in related cases has been effectively resolved, and what difficulties are still faced in the governance of high-altitude parabolas, the reporter launched an investigation.

The warning effect of "prison" is obvious

In recent years, high-altitude parabolic injuries have occurred from time to time across the country, and high-altitude parabolas have become "pain over the city".

On March 1 last year, the "Amendment to the Criminal Law of the People's Republic of China (Eleven)" added the crime of throwing objects from high altitudes, stipulating that "throwing objects from buildings or other high altitudes, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than one year, criminal detention or public surveillance. , and concurrently or solely fined.”

On the day when the crime of high-altitude throwing was officially sentenced, the People's Court of Liyang City, Changzhou, Jiangsu heard the first case of high-altitude throwing crime. 2000 dollars.

The Guangzhou Yuexiu District Court ordered that the parents of the children who dropped the mineral water bottle from the 35th floor and injured the elderly should compensate the other party for medical expenses and nursing expenses totaling more than 90,000 yuan. A fine of 3,000 yuan per month has also been imposed... Over the past year, a series of high-altitude parabolic cases have been judged justly, effectively safeguarding the rights and interests of people's lives and property.

Attorney Li Chunlin, director of Chongqing Senmu Law Firm, believes that the law provides a clear and specific legal basis for the conviction and punishment of suspected high-altitude throwing crimes, and has a deterrent effect on illegal acts.

The reporter learned from interviews in Jiulongpo District and Yuzhong District of Chongqing that the number of high-altitude parabolic cases has decreased significantly since the one-year prison sentence.

Yu Xingjiang, deputy chief of the Science and Technology Information Section of the Jiulongpo District Bureau of the Chongqing Municipal Public Security Bureau, introduced that according to the background data of the Jiulongpo District Intelligent Early Warning and Monitoring System, since March last year, the number of high-altitude parabolic behaviors captured in the monitoring and prevention area has dropped by more than 70%.

Why do high-altitude parabolas happen so often?

The reporter learned from an interview that although the crime of high-altitude throwing has been sentenced, high-altitude parabolic behavior still occurs from time to time.

According to Yu Xingjiang, according to the analysis of the monitoring background, the parabolic objects are mainly garbage bags, beverage bottles, wine bottles, small toys and other daily necessities. Among them, cigarette butts are the most common, accounting for nearly 40% of the parabolic objects. The evening and night are high-altitude parabolic time periods. , children littering, habitual littering, etc. are the main reasons for high-altitude projectiles.

On March 25, 2021, the Hulan District Court of Harbin City held a public hearing to hear the first high-altitude projectile crime case in Heilongjiang Province. The defendant Liu Moumou was sentenced to 6 months in prison and fined 2,000 yuan for the high-altitude projectile crime. .

After a trial, the court found out that Liu Moumou quarreled with his father over trivial matters after drinking. In order to vent his emotions, he threw a glass alcohol bottle at his own window. The alcohol bottle broke through the window glass and fell downstairs. The car below was smashed.

On January 4 this year, a 4-year-old boy was hit on the head by a glass liquor bottle thrown from a high altitude in Jiayun Shanshuicheng Community, Yuzhong District, Chongqing City. He was injured and bled and was sent to the hospital for emergency treatment.

After investigation by the police, it was found that the suspect, Fu Mou, was upset because of trivial matters. To vent, he threw the empty wine bottle from the balcony at night with the strength of the wine.

Li Chunlin believes that some people lack foresight of the legal consequences that their actions may lead to, and take it for granted that throwing them away is not illegal.

However, when the perpetrator is emotionally excited, an excessive act may have serious consequences, touch the bottom line of the law, and may even be held criminally responsible.

Combining prevention and control, guarding the "safety above the head"

The reporter visited some communities in Chongqing and found that although the law clearly stipulates the crime of parabolic parabola, the specific judicial practice is still difficult to obtain evidence and identify.

In Jujin Community, Jiangbei District, Chongqing City, a resident said that a few days ago, an old lady was smashed by a glass bottle in the garage of the community, and she fell to the ground bleeding, and the person who threw the bottle has not yet been found.

A staff member of Langqing Plaza Property in Jiangbei District, Chongqing said that it is more difficult for commercial properties to obtain evidence of high-altitude parabolas, because there are many merchants and residents involved, and the mobility of personnel is greater. Not the "perpetrator".

In order to solve the problem of high-altitude parabolic evidence collection, various places have relied on various scientific and technological means to strengthen the monitoring and evidence collection of high-altitude parabolic behavior.

The Jiulongpo District Branch of Chongqing Public Security Bureau launched the high-altitude parabolic intelligent early warning and monitoring system "Watcher", which realizes 24-hour active capture and real-time alarm for high-altitude parabolic behavior. At present, 23 sets of front-end equipment have been installed in 5 areas of the district, totaling 53 Snap shots.

In the patrol supervision area, once a high-altitude parabola occurs, the system will not only automatically generate a panoramic trajectory map marking the time and position of the parabola and a 6-10 second associated parabola video, but also archive it as a parabola record , on the one hand, it is stored in the video cloud platform, and on the other hand, the piece of information is pushed to the mobile terminal of the police station in the jurisdiction and the person in charge of the relevant property.

"According to the parabolic records, the community police and property personnel will immediately come to the door to check and advise." Yu Xingjiang said that with a large amount of data support, the "Watcher" system will automatically sort out and analyze the frequency of points, high-incidence periods, parabolic types, etc. The public security department provides strong technical support for verification, retrospective, early warning and conflict resolution.

It is understood that the "Watcher" system has been promoted and used in Chongqing, Shenzhen, Nanchang, Yunnan Lufeng and other places.

In the future, the police in some places will also cooperate with relevant departments to incorporate high-altitude parabolic technical defense facilities into relevant construction standards when new or old communities are renovated.

Yu Xingjiang said that the popularity of the "Watcher" system is still not wide enough. There are more than 2,000 high-rise buildings in Jiulongpo District, and each building has different sides. The existing equipment is far from enough to cover all the buildings that may have parabolic phenomena. It is not only necessary to install more anti-high-altitude parabolic monitoring systems in new and old communities, but also the participation of the whole society.

Li Chunlin said that after the high-altitude projectiles are incarcerated, it is necessary to increase the publicity of the law, so that more people can realize the dangers of high-altitude parabolas and the legal responsibilities they may bear, so that more people can understand that high-altitude parabolas will not only harm others but also themselves. , and strive to eliminate or reduce high-altitude parabolas from the source.

In addition, property companies, property committees, community streets and relevant government departments are also required to work together to safeguard the "safety on the head".
