Doctor Lionel Guedj, dentist in the 15th arrondissement, in the northern districts of Marseille, and his father, Carnot, dentist employed by the son, are accused of intentional violence resulting in mutilation or permanent disability (in this case, the extraction of teeth without medical justification), and fraud with health insurance and with 47 mutual insurance companies, for acts allegedly committed between 2006 and 2012.

In its order for reference, the Marseille prosecutor's office points to "many shortcomings in the provision of dental care, not in accordance with the acquired data of science and the rules of the art", in particular on the part of Lionel Guedj.

“In the majority of cases, patients consulted for care concerning one or two teeth, and therefore for reasons that could be described as “classic” (decay, toothache, scaling, etc.), writes the prosecution.

Under the pretext that all their teeth were, despite appearances, in poor condition and at risk of falling out, the practitioner had convinced them to treat all of their teeth”, all with the promise of having “a star smile”. .

Patients who still suffer today from the consequences of the actions of doctors Guedj.

"Devitalizations have often been performed on several teeth, sometimes around twenty, with serious consequences for the patients: multiple infections, apical lesions, gingivitis, chewing pain, occlusal disorders...", notes the prosecution in its order for reference.

“My client assures that there was no desire to exercise violence against anyone, claims Me Frédéric Monneret, lawyer for Lionel Guedj.

He has always done the best he could, and if he admits that there may have been faults, they are faults of recklessness, and not deliberate faults.

The two dentists face up to ten years in prison

Money as motive

“To make money, they massacred people, is alarmed by Me Louisa Straboni, also a lawyer for several victims.

One of my clients was only 19 when Dr. Guedj pulled out all of his teeth.

“In front of the investigators, the third dentist of the Guedj cabinet even affirms that Lionel Guedj acted like a salesman, “capable of selling ice cream to an Eskimo”, and knowing how to create an emotional bond with his patients.

“Doctor Guedj abused the trust of these people, accuses Me Jullien, lawyer for several victims.

People came for sometimes superficial work, and they pulled out their teeth to put implants, because it's juicier.

“Teeth were depulped for mercantile purposes,” notes the prosecution in its order for dismissal.

And to add: "The Guedj cabinet billed on average four times more acts per day than the regional average, had a conservative care activity 5.6 times higher than the regional average and a prosthetic activity 15 times higher than the regional average.

He was at the head of the dental surgeons at the national level in terms of fees invoiced, with in particular an amount 15.8 higher than the national average in 2010. His turnover was 2.6 million euros for an average department of 180,000 euros.

“A record profitability that has enabled Lionel Guedj to acquire dozens of properties, luxury vehicles, works of art and even a yacht.

According to the magistrates, “the professional activity of doctors Guedj was based on an optimal profit system exploiting to the maximum the conditions of coverage of the health insurance.

“The patient population of the district concerned was mainly made up of socially disadvantaged people, notes the prosecution.

Thus, 98.9% of Doctor Guedj's fees were paid to him directly by Health Insurance according to the principle of third-party payment.

In addition, his patients were beneficiaries of CMU for a rate of 46% “The damage to health insurance is estimated between 3.6 and 4.7 million euros.

More than 300 victims

The main particularity of this trial lies in the number of victims.

According to a recent press release from the Marseille prosecutor's office, 322 former patients of doctors Guedj have filed civil suits.

The trial will also be relocated to a brand new room, the aptly named “exceptional trial” room, nestled in the Caserne du Muy, in the third arrondissement of Marseille.

"The idea of ​​facing more than 300 civil parties is likely to stress my client, and that can be understood", slips Me Monneret, Lionel Guedj's lawyer.

Of these 322 civil parties, a hundred of them are required to testify at the bar, at the rate of ten per day, for eleven days.

The trial which opens this Monday is held more than ten years after the first complaint of the primary fund of Health Insurance of Bouches-du-Rhône to the public prosecutor of Marseille.

"My client is happy that this trial is finally coming," says Me Monneret.

I could plead the nullity of the trial from the opening, with regard to non-compliance with the guarantee of reasonable time as understood by the European Court of Human Rights.

But the civil parties have been waiting for this trial for so long, I prefer that the trial take place and use this argument in my defense.

The end of the trial is scheduled for April 6.
