Give physicians the discretion to "over-prescribe medication"
The "Law of the People's Republic of China on Physicians" came into effect on March 1, and the "Law of the People's Republic of China on Practicing Physicians", which had been in force for more than 20 years, was repealed at the same time.
There are many bright spots in the Physician Law. For example, Article 27 stipulates that the state encourages physicians to actively participate in first aid services in public places such as public transportation; physicians who cause damage to recipients due to their voluntary implementation of first aid shall not bear civil liability.
In addition, the Physician's Law grants physicians the discretion to "exceed the prescribed medication", specifies the relevant norms for "multi-site practice", and specifies the requirements for "intern doctors" to participate in clinical diagnosis and treatment activities.
Safeguarding the rights of minors under guardianship
The judicial interpretation of the General Provisions of the Civil Code will come into force on March 1.
In terms of protecting the rights and interests of minors, the Interpretation stipulates that if the parents of minors enter into an agreement with other persons with guardianship qualifications according to law, stipulating that the parents with guardianship ability shall be exempted from the guardianship duties, the people's court shall not support it.
When the court appoints a guardian in accordance with relevant regulations, it shall respect the true wishes of the ward, and designate according to the principle that is most beneficial to the ward, with specific reference to factors such as "the degree of closeness of life and emotional connection with the ward".
