Biden has the opportunity to nominate a candidate for the court after Judge Stephen Breyer announced that he is retiring.

Three women are part of the current composition of judges in HD, of which Sonia Sotomayor is the first to have a Latin American background.

HD's next judge replaces 83-year-old Breyer, who has a liberal view of how the American constitution should be interpreted.

This does not change the balance of power, where six out of nine judges are considered to belong to a conservative and literal view of the constitution.

The Senate must approve

The 51-year-old Ketanji Brown Jackson has a background as, among other things, a general defender, which is unusual in HD.

She is currently a judge on the Court of Appeal of the District of Columbia.

The nomination must be approved by the Senate, where the balance of power is equal between Republicans and Democrats, with 50 votes each.

Vice President Kamala Harris, Democrat, casts a decisive vote if the Senate cannot agree.
