The 57-year-old's lawyer Niklas Kapell announces in an email to SVT Nyheter Småland the background to the appeal:

“My client has appealed the district court's ruling and requested that the Court of Appeal acquit him.

My client does not share the district court's assessment and he believes that he has not been able to anticipate or prevent the medical condition that arose while driving. ”

The 57-year-old driver was convicted in Kalmar District Court for causing another person's death, gross causing another person's bodily injury and gross negligence in traffic.

Drove two people to death

It was in July 2020 that a family from Skåne had just arrived at a campsite in Färjestaden on Öland.

The mother, father and their two children took a ride with their bikes.

On the way through a summer cottage area adjacent to the campsite, a car at high speed suddenly came driving.

The family was hit.

The mother and one of the children died in connection with the accident.

Shortly before, the 57-year-old had driven very close to another family who was walking along the small road.

Suffers from epilepsy

During the trial in the district court which was held in November last year, the defense said that the man was currently suffering from an unknown illness.

The prosecutor claimed that the 57-year-old suffers from an epilepsy-like condition that is triggered by stress attacks, and that he was aware of this.

Since the accident occurred during such an attack, the man would be held responsible for what happened.

That assessment was also made by Kalmar District Court, which convicted the man.
