A man accuses a woman of stealing the installments of an “association”

Al Dhafra Court of First Instance ruled that a woman must pay a man 220,000 dirhams in the value of the installments of the association that he paid to her, which she took for herself.

The court also ruled obligating the defendant to pay the plaintiff five thousand dirhams in compensation for the material and moral damages he sustained due to his failure to benefit from the amount.

The man had filed a lawsuit against the woman, demanding that she repay him 220,000 dirhams, and pay him 20,000 dirhams as compensation for material and moral damage, in addition to obligating her to pay fees, expenses and attorney fees, indicating that he participated in the association established by the defendant in a premium. A monthly amount of 20,000 dirhams for a period of 20 months, with a total of 400,000 dirhams, and making financial transfers to the defendant's account.

After paying 11 installments, totaling 220,000 dirhams, he was surprised that the defendant took the association's money from the participants and did not transfer it to the owners of the right to receive it.

The court confirmed the validity of the plaintiff’s claim, including the textual conversations that were attached between him and the defendant, and then evidence was available in the lawsuit, which makes the lawsuit based on a valid basis of reality and law, especially since the defendant did not attend to refute what the plaintiff submitted.

The court indicated that the judgment for compensation for material damage requires the prejudice to the financial interest of the injured party, and that the damage is proven by the fact that it has already occurred or its occurrence in the future is inevitable.

The court ruled to obligate the defendant to pay the plaintiff an amount of 220,000 dirhams and compensate him with five thousand dirhams, in addition to obligating her to pay fees and expenses and in exchange for attorneys' fees.
