A decision that should make noise.

This Wednesday, the Court of Cassation rejected an appeal from the family of Shaoyao Liu, this Chinese father killed in 2017 by a police officer during an intervention at his home in Paris, making the official's dismissal final.

The criminal chamber of the highest French judicial court did not admit the appeal of the Liu family, which contested the dismissal granted to the police officer in July 2019, then confirmed on appeal in November 2020, the official benefiting from self-defense.

The death of Shaoyao Liu had sparked the anger of the Chinese community during several demonstrations of an unprecedented scale.

The Court of Cassation rejects the appeal

"After having examined both the admissibility of the appeal and the procedural documents, the Court of Cassation finds that there is, in this case, no means of such a nature as to allow the appeal to be admitted", according to this decision.

On March 26, 2017 shortly after 8 p.m., the police went to a housing estate in the 19th arrondissement of Paris, alerted by a neighbor who had reported the presence of Shaoyao Liu, very agitated and holding in his hand what he believed to be a knife.

Fearing danger, the police, two men and a woman equipped with an assault rifle and pistols, broke down the door of the home.

A handful of seconds later, Damien V. fired a shot, fatally hitting Shaoyao Liu, 56, in the heart, under the eyes of his children.

A witness contradicts the version of the police

According to the version of the police, the victim had just assaulted the bearer of the assault rifle with his scissors.

“He plants me!

the latter would have shouted, provoking the return fire of his colleague.

For the Liu children, their father never touched anyone: the blade was a pair of scissors, which he used to scale fish.

A neighbor, witness from the hallway, assures that he never heard the police shout "he's planting me" before the shot was fired.

Questioned by AFP, the witness had described an "extremely violent intervention and totally out of step with the situation", by police officers "little in control".

Solicited neither the lawyer of the police officer, Me Anne-Laure Compoint, nor that of the family, Me Pierre Lumbroso, had reacted immediately.
