Imprisonment and a fine is the punishment of the “admin” in the crimes of “social media” groups

Legal Counsel, Dr. Youssef Al-Sharif, warned of the punishment prescribed for crimes that occur through social media accounts, as there is a legal responsibility on the “admin” who is the person who manages the account in the event of crimes punishable by law, including deliberately manipulating digital evidence and hiding it from the eyes of enforcement officials. the law.

Al-Sharif said, in episodes broadcast by "Emirates Today" on its platforms to shed light on the newly issued laws, including the rumor law, that "the virtual world can be imagined like the reality we live in, but in electronic form," adding that "the law imposed a penalty on the person responsible for the archive. And keeping the papers and correspondences of any company, school, university, or any professional or commercial institution, in case it breaches its obligations to preserve these documents, especially if he deliberately tampered with them, concealed them or changed their content.”

In the virtual world, there is another person parallel, who performs these same tasks, called the “admin” or the “administrator”, where one of his responsibilities is to manage the electronic account and control passwords, and he can delete or add the content of messages, and he can easily manipulate this Content.

Al-Sharif cautioned that the Rumors and Cybercrime Law sets a penalty on the person responsible for the accounts on social networking sites in the event that a crime punishable by law occurs through these accounts, including deliberately tampering, concealing or changing evidence of a crime.

He said that the Rumors Law in Article (18) specified a text related to the role of this official in the event of tampering with digital evidence, and stipulated that “he shall be punished by imprisonment for a period of no less than six months and a fine of no less than 200,000 dirhams, or one of these two penalties, each responsible for managing A website, including account holders on social media, or an account on a computer network, e-mail, or information system, that has hidden or tampered with digital evidence, for one of the crimes stipulated in this Decree-Law, with the intent of impeding the work of research, investigation, investigation or other competent authorities ».

He pointed out that the legislator deliberately stipulated the availability of criminal intent, which means that he was deliberately committing the act, and not for his mismanagement or unintended mistake, calling on the person responsible for sites and accounts to the importance of taking precautions so that he does not find himself liable to accountability, especially since he cannot guarantee the quality of people With whom he deals, they may be his friends and co-workers, and they have friendly relations, but if any malfunction occurs from a person of bad faith among them, he can bear the responsibility for this act.
